55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to additional court costs for certain traffic offenses
88 that occur in a municipality.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Article 102.014(c), Code of Criminal Procedure,
1111 is amended to read as follows:
1212 (c) A person convicted of an offense under Subtitle C, Title
1313 7, Transportation Code, when the offense occurs within a school
1414 crossing zone as defined by Section 541.302 of that code, shall pay
1515 as court costs $25 in addition to other taxable court costs. A
1616 person convicted of an offense under Section 545.066,
1717 Transportation Code, shall pay as court costs $25 in addition to
1818 other taxable court costs. The additional court costs under this
1919 subsection shall be collected in the same manner that other fines
2020 and taxable court costs in the case are collected and shall be
2121 assessed only when the offense occurs in a municipality.
2222 SECTION 2. The change in law made by this Act applies only
2323 to a person convicted of an offense that was committed on or after
2424 the effective date of this Act. A person convicted of an offense
2525 that was committed before the effective date of this Act is covered
2626 by the law in effect when the offense was committed, and the former
2727 law is continued in effect for that purpose. For purposes of this
2828 section, an offense was committed before the effective date of this
2929 Act if any element of the violation or offense occurred before that
3030 date.
3131 SECTION 3. This Act takes effect September 1, 2009.
