7 | 7 | | relating to additional court costs for certain traffic offenses |

8 | 8 | | that occur in a municipality. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Article 102.014(c), Code of Criminal Procedure, |
---|
11 | 11 | | is amended to read as follows: |
---|
12 | 12 | | (c) A person convicted of an offense under Subtitle C, Title |
---|
13 | 13 | | 7, Transportation Code, when the offense occurs within a school |
---|
14 | 14 | | crossing zone as defined by Section 541.302 of that code, shall pay |
---|
15 | 15 | | as court costs $25 in addition to other taxable court costs. A |
---|
16 | 16 | | person convicted of an offense under Section 545.066, |
---|
17 | 17 | | Transportation Code, shall pay as court costs $25 in addition to |
---|
18 | 18 | | other taxable court costs. The additional court costs under this |
---|
19 | 19 | | subsection shall be collected in the same manner that other fines |
---|
20 | 20 | | and taxable court costs in the case are collected and shall be |
---|
21 | 21 | | assessed only when the offense occurs in a municipality. |
---|
22 | 22 | | SECTION 2. The change in law made by this Act applies only |
---|
23 | 23 | | to a person convicted of an offense that was committed on or after |
---|
24 | 24 | | the effective date of this Act. A person convicted of an offense |
---|
25 | 25 | | that was committed before the effective date of this Act is covered |
---|
26 | 26 | | by the law in effect when the offense was committed, and the former |
---|
27 | 27 | | law is continued in effect for that purpose. For purposes of this |
---|
28 | 28 | | section, an offense was committed before the effective date of this |
---|
29 | 29 | | Act if any element of the violation or offense occurred before that |
---|
30 | 30 | | date. |
---|
31 | 31 | | SECTION 3. This Act takes effect September 1, 2009. |
