| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Subchapter B, Chapter 11, Parks and Wildlife |
|---|
| 9 | 9 | | Code, is amended by adding Section 11.0193 to read as follows: |
|---|
| 10 | 10 | | Sec. 11.0193. PURCHASE OF FIREARM FROM DEPARTMENT BY |
|---|
| 11 | 11 | | COMMISSIONED PEACE OFFICER. (a) An employee commissioned by the |
|---|
| 12 | 12 | | director as a peace officer may purchase for an amount set by the |
|---|
| 13 | 13 | | department, not to exceed fair market value, a firearm issued to the |
|---|
| 14 | 14 | | person by the department if: |
|---|
| 15 | 15 | | (1) the firearm is not listed as a prohibited weapon |
|---|
| 16 | 16 | | under Section 46.05, Penal Code; and |
|---|
| 17 | 17 | | (2) the firearm is retired by the department for |
|---|
| 18 | 18 | | replacement purposes. |
|---|
| 19 | 19 | | (b) The commission may adopt rules for the sale of a retired |
|---|
| 20 | 20 | | firearm under this section to a peace officer commissioned by the |
|---|
| 21 | 21 | | director. |
|---|
| 22 | 22 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 23 | 23 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 24 | 24 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 25 | 25 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 26 | 26 | | Act takes effect September 1, 2009. |
