55 relating to the purchase of a retired firearm from the Parks and

77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Subchapter B, Chapter 11, Parks and Wildlife
99 Code, is amended by adding Section 11.0193 to read as follows:
1010 Sec. 11.0193. PURCHASE OF FIREARM FROM DEPARTMENT BY
1111 COMMISSIONED PEACE OFFICER. (a) An employee commissioned by the
1212 director as a peace officer may purchase for an amount set by the
1313 department, not to exceed fair market value, a firearm issued to the
1414 person by the department if:
1515 (1) the firearm is not listed as a prohibited weapon
1616 under Section 46.05, Penal Code; and
1717 (2) the firearm is retired by the department for
1818 replacement purposes.
1919 (b) The commission may adopt rules for the sale of a retired
2020 firearm under this section to a peace officer commissioned by the
2121 director.
2222 SECTION 2. This Act takes effect immediately if it receives
2323 a vote of two-thirds of all the members elected to each house, as
2424 provided by Section 39, Article III, Texas Constitution. If this
2525 Act does not receive the vote necessary for immediate effect, this
2626 Act takes effect September 1, 2009.
