|---|
| 9 | 9 | | environmental conditions inside certain confinement facilities. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter A, Chapter 501, Government Code, is |
|---|
| 12 | 12 | | amended by adding Section 501.020 to read as follows: |
|---|
| 13 | 13 | | Sec. 501.020. OPERATIONS MANUAL; TEMPERATURE LOG. (a) The |
|---|
| 14 | 14 | | department shall develop and use an operations manual that |
|---|
| 15 | 15 | | describes the standards and procedures to be followed for |
|---|
| 16 | 16 | | maintaining satisfactory environmental conditions inside each |
|---|
| 17 | 17 | | facility operated by or under contract with the department for the |
|---|
| 18 | 18 | | confinement of inmates. |
|---|
| 19 | 19 | | (b) The operations manual must include heat management |
|---|
| 20 | 20 | | protocols and must require that a daily temperature log indicating |
|---|
| 21 | 21 | | the temperature recorded at various times of the day be kept at each |
|---|
| 22 | 22 | | of the facilities described by Subsection (a). |
|---|
| 23 | 23 | | (c) Notwithstanding any other law, the department shall |
|---|
| 24 | 24 | | develop and use an operations manual that meets the requirements of |
|---|
| 25 | 25 | | this section with respect to each state jail felony facility |
|---|
| 26 | 26 | | operated by or under contract with the department. |
|---|
| 27 | 27 | | SECTION 2. The Texas Department of Criminal Justice shall |
|---|
| 28 | 28 | | develop and begin using the operations manual required under |
|---|
| 29 | 29 | | Section 501.020, Government Code, as added by this Act, not later |
|---|
| 30 | 30 | | than January 1, 2010. |
|---|
| 31 | 31 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 32 | 32 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 33 | 33 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 34 | 34 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 35 | 35 | | Act takes effect September 1, 2009. |
