66 AN ACT
77 relating to excluding a child from the immunization registry.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Sections 161.007(a), (b), (b-1), (c), (d), (f),
1010 and (k), Health and Safety Code, are amended to read as follows:
1111 (a) The department, for the primary purpose of establishing
1212 and maintaining a single repository of accurate, complete, and
1313 current immunization records to be used in aiding, coordinating,
1414 and promoting efficient and cost-effective childhood communicable
1515 disease prevention and control efforts, shall establish and
1616 maintain an immunization registry. The executive commissioner of
1717 the Health and Human Services Commission [department] by rule shall
1818 develop guidelines to:
1919 (1) protect the confidentiality of patients in
2020 accordance with Section 159.002, Occupations Code;
2121 (2) inform a parent, managing conservator, or guardian
2222 of each patient younger than 18 years of age about the registry; and
2323 (3) permit [require the written consent of] a parent,
2424 managing conservator, or guardian of a patient younger than 18
2525 years of age to have the patient excluded from [before any
2626 information relating to the patient is included in] the registry[;
2727 [(4) permit a parent, managing conservator, or
2828 guardian of a patient younger than 18 years of age to withdraw
2929 consent for the patient to be included in the registry; and
3030 [(5) determine the process by which consent is
3131 verified, including affirmation by a health care provider, birth
3232 registrar, regional health information exchange, or local
3333 immunization registry that consent has been obtained].
3434 (b) The immunization registry must contain information on
3535 the immunization history that is obtained by the department under:
3636 (1) this section of each person who is younger than 18
3737 years of age [and for whom consent has been obtained in accordance
3838 with guidelines adopted under Subsection (a)];
3939 (2) Section 161.00705 of persons immunized to prepare
4040 for or in response to a declared disaster, public health emergency,
4141 terrorist attack, hostile military or paramilitary action, or
4242 extraordinary law enforcement emergency; and
4343 (3) Section 161.00706 of first responders or their
4444 immediate family members.
4545 (b-1) [The department shall remove from the registry
4646 information for any person for whom consent has been
4747 withdrawn.] The department may not retain individually
4848 identifiable information about any person:
4949 (1) for whom a request to be excluded from the registry
5050 has been received under this section [consent has been withdrawn];
5151 (2) for whom a consent for continued inclusion in the
5252 registry following the end of the declared disaster, public health
5353 emergency, terrorist attack, hostile military or paramilitary
5454 action, or extraordinary law enforcement emergency has not been
5555 received under Section 161.00705(f); or
5656 (3) for whom a request to be removed from the registry
5757 has been received under Section 161.00706(e).
5858 (c) A payor that receives data elements from a health care
5959 provider who administers an immunization to a person younger than
6060 18 years of age shall provide the data elements to the department.
6161 A payor is required to provide the department with only the data
6262 elements the payor receives from a health care provider. The data
6363 elements shall be submitted in a format prescribed by the
6464 department. [The department shall verify consent before including
6565 the reported information in the immunization registry.] The
6666 department may not retain individually identifiable information
6767 about a person for whom the department receives a request to be
6868 excluded from the registry [consent cannot be verified].
6969 (d) A health care provider who administers an immunization
7070 to a person younger than 18 years of age shall provide data elements
7171 regarding an immunization to the department. The data elements
7272 shall be submitted in a format prescribed by the department. [The
7373 department shall verify consent before including the information in
7474 the immunization registry.] The department may not retain
7575 individually identifiable information about a person for whom the
7676 department receives a request to be excluded from the registry
7777 [consent cannot be verified].
7878 (f) The department and health care providers may use the
7979 registry to provide notices by mail, telephone, personal contact,
8080 or other means to a parent, managing conservator, or guardian
8181 regarding the person's [his or her] child or ward who is due or
8282 overdue for a particular type of immunization according to the
8383 department's immunization schedule. The notice must contain
8484 instructions for the parent, managing conservator, or guardian to
8585 request that future notices not be sent and to remove the child's
8686 immunization record from the registry and any registry-related
8787 records. The notice must describe the procedure to report a
8888 violation if a child's immunization record is included in the
8989 registry after requesting exclusion. The department shall consult
9090 with health care providers to determine the most efficient and
9191 cost-effective manner of using the registry to provide those
9292 notices.
9393 (k) The executive commissioner of the Health and Human
9494 Services Commission [board] shall adopt rules to administer this
9595 section.
9696 SECTION 2. Sections 161.0071(a) and (b), Health and Safety
9797 Code, are amended to read as follows:
9898 (a) The first time the department receives registry data for
9999 a child [for whom the department has received consent to be included
100100 in the registry,] from a person other than the child's parent,
101101 managing conservator, or guardian, the department shall send a
102102 written notice to the child's parent, managing conservator, or
103103 guardian disclosing:
104104 (1) that providers and payors may be sending the
105105 child's immunization information to the department, but the
106106 department may not keep the information if the parent, managing
107107 conservator, or guardian chooses to exclude the child from the
108108 registry;
109109 (2) the information that is included in the registry;
110110 (3) the persons to whom the information may be
111111 released under Section 161.008(d);
112112 (4) the purpose and use of the registry;
113113 (5) the procedure to exclude a child from the
114114 registry; and
115115 (6) the procedure to report a violation if a parent,
116116 managing conservator, or guardian discovers a child is included in
117117 the registry after exclusion has been requested.
118118 (b) On receipt of a written request to exclude a child's
119119 immunization records from [discovering that consent to be included
120120 in] the registry [has not been granted], the department shall
121121 exclude the child's immunization records from the registry and any
122122 other registry-related department record that individually
123123 identifies the child.
124124 SECTION 3. Sections 161.008(c) and (h), Health and Safety
125125 Code, are amended to read as follows:
126126 (c) The department may obtain the data constituting an
127127 immunization record for a child from a public health district, a
128128 local health department, the child's parent, managing conservator,
129129 or guardian, a physician to the child, a payor, or any health care
130130 provider licensed or otherwise authorized to administer vaccines.
131131 [The department shall verify consent before including the reported
132132 information in the immunization registry.] The department may not
133133 retain individually identifiable information about a person for
134134 whom the department receives a request to be excluded from the
135135 registry [consent cannot be verified].
136136 (h) The executive commissioner of the Health and Human
137137 Services Commission [board] shall adopt rules to implement this
138138 section.
139139 SECTION 4. Section 161.0107(c), Health and Safety Code, as
140140 added by Chapter 352 (S.B. 204), Acts of the 80th Legislature,
141141 Regular Session, 2007, is amended to read as follows:
142142 (c) The executive commissioner of the Health and Human
143143 Services Commission by rule shall specify:
144144 (1) the fields necessary to populate the immunization
145145 registry[, including a field that indicates the patient's consent
146146 to be listed in the immunization registry has been obtained]; and
147147 (2) the data standards that must be used for
148148 electronic submission of immunization information.
149149 SECTION 5. Sections 161.007(a-1) and (e), Health and Safety
150150 Code, are repealed.
151151 SECTION 6. This Act takes effect September 1, 2009.
