| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter E, Chapter 29, Education Code, is |
|---|
| 11 | 11 | | amended by adding Section 29.162 to read as follows: |
|---|
| 12 | 12 | | Sec. 29.162. REQUIREMENTS APPLICABLE TO STATE CENTER FOR |
|---|
| 13 | 13 | | EARLY CHILDHOOD DEVELOPMENT. (a) The State Center for Early |
|---|
| 14 | 14 | | Childhood Development shall: |
|---|
| 15 | 15 | | (1) comply with the contract management requirements |
|---|
| 16 | 16 | | prescribed by Chapter 2262, Government Code; |
|---|
| 17 | 17 | | (2) not later than December 1 of each even-numbered |
|---|
| 18 | 18 | | year, prepare and submit to the presiding officers of the Senate |
|---|
| 19 | 19 | | Committee on Finance and the House Appropriations Committee a |
|---|
| 20 | 20 | | report detailing the use of all state money provided to the center |
|---|
| 21 | 21 | | to fund early childhood education services; and |
|---|
| 22 | 22 | | (3) provide center staff to appear before a standing |
|---|
| 23 | 23 | | committee of the senate or house of representatives with |
|---|
| 24 | 24 | | jurisdiction over public primary and secondary education on request |
|---|
| 25 | 25 | | of the presiding officer of the committee. |
|---|
| 26 | 26 | | (b) In each even-numbered year, the State Center for Early |
|---|
| 27 | 27 | | Childhood Development shall allow an external evaluation, by an |
|---|
| 28 | 28 | | organization under contract with the agency for that purpose, |
|---|
| 29 | 29 | | regarding the management and implementation of demonstration |
|---|
| 30 | 30 | | projects authorized by Section 29.160 and the school readiness |
|---|
| 31 | 31 | | certification system developed in accordance with Section 29.161. |
|---|
| 32 | 32 | | (c) The organization completing the external evaluation |
|---|
| 33 | 33 | | under Subsection (b) must be selected through a competitive process |
|---|
| 34 | 34 | | developed by the agency. |
|---|
| 35 | 35 | | SECTION 2. This Act takes effect September 1, 2009. |
