| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Subsections (b) and (d), Section 61.051, Labor |
|---|
| 13 | 13 | | Code, are amended to read as follows: |
|---|
| 14 | 14 | | (b) A wage claim must be filed in a manner and [in writing] |
|---|
| 15 | 15 | | on a form prescribed by the commission and must be verified by the |
|---|
| 16 | 16 | | employee. |
|---|
| 17 | 17 | | (d) The employee may file the wage claim: |
|---|
| 18 | 18 | | (1) in person at an office of the commission; [or] |
|---|
| 19 | 19 | | (2) by mailing the claim to an address designated by |
|---|
| 20 | 20 | | the commission; |
|---|
| 21 | 21 | | (3) by faxing the claim to a fax number designated by |
|---|
| 22 | 22 | | the commission; or |
|---|
| 23 | 23 | | (4) by any other means adopted by the commission by |
|---|
| 24 | 24 | | rule. |
|---|
| 25 | 25 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 26 | 26 | | to a wage claim that is filed with the Texas Workforce Commission on |
|---|
| 27 | 27 | | or after the effective date of this Act. A wage claim filed before |
|---|
| 28 | 28 | | that date is governed by the law in effect on the date that the claim |
|---|
| 29 | 29 | | was filed, and the former law is continued in effect for that |
|---|
| 30 | 30 | | purpose. |
|---|
| 31 | 31 | | SECTION 3. This Act takes effect September 1, 2009. |
