5	5	relating to the grounds for removal of a member of the board of
6	6	directors of the Lynn County Hospital District.
7	7	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	8	SECTION 1. Subsection (a), Section 4A, Chapter 66, Acts of
9	9	the 60th Legislature, Regular Session, 1967, is amended to read as
10	10	follows:
11	11	(a) It is a ground for removal from the board of directors
12	12	that a member:
13	13	(1) is absent from more than half [three-fourths] of
14	14	the regularly scheduled board meetings that the member is eligible
15	15	to attend during a calendar year without an excuse approved by a
16	16	majority vote of the board; or
17	17	(2) fails to timely pay a federal, state, or local tax,
18	18	including an ad valorem tax.
19	19	SECTION 2. Subsection (a), Section 1054.0565, Special
20	20	District Local Laws Code, as effective September 1, 2009, is
21	21	amended to read as follows:
22	22	(a) It is a ground for removal from the board that a
23	23	director:
24	24	(1) is absent from more than half [three-fourths] of
25	25	the regularly scheduled board meetings that the director is
26	26	eligible to attend during a calendar year without an excuse
27	27	approved by a majority vote of the board; or
28	28	(2) fails to timely pay a federal, state, or local tax,
29	29	including an ad valorem tax.
30	30	SECTION 3. (a) Section 1 of this Act takes effect only if
31	31	the Act of the 81st Legislature, Regular Session, 2009, relating to
32	32	nonsubstantive additions to and corrections in existing codes does
33	33	not become law. If the Act of the 81st Legislature, Regular
34	34	Session, 2009, relating to nonsubstantive additions to and
35	35	corrections in existing codes becomes law, Section 1 of this Act has
36	36	no effect.
37	37	(b) Section 2 of this Act takes effect only if the Act of the
38	38	81st Legislature, Regular Session, 2009, relating to
39	39	nonsubstantive additions to and corrections in existing codes
40	40	becomes law. If the Act of the 81st Legislature, Regular Session,
41	41	2009, relating to nonsubstantive additions to and corrections in
42	42	existing codes does not become law, Section 2 of this Act has no
43	43	effect.
44	44	SECTION 4. This Act takes effect September 1, 2009.
