77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. The heading to Title 10, Human Resources Code, is
99 amended to read as follows:
1010 TITLE 10. JUVENILE BOARDS, JUVENILE PROBATION DEPARTMENTS, [AND]
1111 FAMILY SERVICES OFFICES, AND OTHER JUVENILE JUSTICE SERVICES
1212 SECTION 2. The heading to Subtitle A, Title 10, Human
1313 Resources Code, is amended to read as follows:
1414 SUBTITLE A. JUVENILE PROBATION SERVICES AND OTHER JUVENILE
1515 JUSTICE SERVICES
1616 SECTION 3. Subchapter C, Chapter 141, Human Resources Code,
1717 is amended by adding Section 141.0422 to read as follows:
1818 Sec. 141.0422. MINIMUM STANDARDS FOR JUVENILE CASE
1919 MANAGERS. (a) The commission shall adopt reasonable rules for
2020 juvenile case managers employed under Article 45.056, Code of
2121 Criminal Procedure, that provide:
2222 (1) a code of ethics, and for the enforcement of that
2323 code;
2424 (2) minimum education requirements; and
2525 (3) minimum training standards, including
2626 requirements that each juvenile case manager receives training in:
2727 (A) the role of the juvenile case manager;
2828 (B) case planning and management;
2929 (C) juvenile law;
3030 (D) courtroom proceedings and presentation;
3131 (E) law enforcement proceedings;
3232 (F) local programs and services for juveniles and
3333 methods by which juveniles may access those programs and services;
3434 and
3535 (G) detecting and preventing abuse,
3636 exploitation, and neglect of children.
3737 (b) To the extent possible, the commission shall adopt rules
3838 substantially similar to the rules applicable to juvenile probation
3939 officers that the commission adopts under Section 141.042.
4040 SECTION 4. Not later than December 1, 2009, the Texas
4141 Juvenile Probation Commission shall adopt the rules required by
4242 Section 141.0422, Human Resources Code, as added by this Act.
4343 SECTION 5. This Act takes effect immediately if it receives
4444 a vote of two-thirds of all the members elected to each house, as
4545 provided by Section 39, Article III, Texas Constitution. If this
4646 Act does not receive the vote necessary for immediate effect, this
4747 Act takes effect September 1, 2009.
