8 | 8 | | SECTION 1. The heading to Title 10, Human Resources Code, is |

17 | 17 | | is amended by adding Section 141.0422 to read as follows: |

18 | 18 | | Sec. 141.0422. MINIMUM STANDARDS FOR JUVENILE CASE |
---|
19 | 19 | | MANAGERS. (a) The commission shall adopt reasonable rules for |
---|
20 | 20 | | juvenile case managers employed under Article 45.056, Code of |
---|
21 | 21 | | Criminal Procedure, that provide: |
---|
22 | 22 | | (1) a code of ethics, and for the enforcement of that |
---|
23 | 23 | | code; |
---|
24 | 24 | | (2) minimum education requirements; and |
---|
25 | 25 | | (3) minimum training standards, including |
---|
26 | 26 | | requirements that each juvenile case manager receives training in: |
---|
27 | 27 | | (A) the role of the juvenile case manager; |
---|
28 | 28 | | (B) case planning and management; |
---|
29 | 29 | | (C) juvenile law; |
---|
30 | 30 | | (D) courtroom proceedings and presentation; |
---|
31 | 31 | | (E) law enforcement proceedings; |
---|
32 | 32 | | (F) local programs and services for juveniles and |
---|
33 | 33 | | methods by which juveniles may access those programs and services; |
---|
34 | 34 | | and |
---|
35 | 35 | | (G) detecting and preventing abuse, |
---|
36 | 36 | | exploitation, and neglect of children. |
---|
37 | 37 | | (b) To the extent possible, the commission shall adopt rules |
---|
38 | 38 | | substantially similar to the rules applicable to juvenile probation |
---|
39 | 39 | | officers that the commission adopts under Section 141.042. |
---|
40 | 40 | | SECTION 4. Not later than December 1, 2009, the Texas |
---|
41 | 41 | | Juvenile Probation Commission shall adopt the rules required by |
---|
42 | 42 | | Section 141.0422, Human Resources Code, as added by this Act. |
---|
43 | 43 | | SECTION 5. This Act takes effect immediately if it receives |
---|
44 | 44 | | a vote of two-thirds of all the members elected to each house, as |
---|
45 | 45 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
46 | 46 | | Act does not receive the vote necessary for immediate effect, this |
---|
47 | 47 | | Act takes effect September 1, 2009. |
