55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the funding of certain activities of the General Land
88 Office pertaining to the management of coastal public land.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 33.604(b), Natural Resources Code, is
1111 amended to read as follows:
1212 (b) The account consists of:
1313 (1) all money appropriated for the purposes of this
1414 subchapter;
1515 (2) grants to this state from the United States for the
1616 purposes of this subchapter;
1717 (3) all money received by this state from the sale of
1818 dredged material; [and]
1919 (4) penalties or costs collected under Section 61.0184
2020 or 63.1814; and
2121 (5) credits made to the land office under Section
2222 151.801, Tax Code.
2323 SECTION 2. Sections 151.801(c) and (c-1), Tax Code, are
2424 amended to read as follows:
2525 (c) Subject to Subsection (c-1), the proceeds from the
2626 collection of the taxes imposed by this chapter on the sale,
2727 storage, or use of sporting goods shall be deposited as follows:
2828 (1) an amount equal to 74 [94] percent of the proceeds
2929 shall be credited to the Parks and Wildlife Department and
3030 deposited as specified in the Parks and Wildlife Code; [and]
3131 (2) an amount equal to six percent of the proceeds
3232 shall be credited to the Texas Historical Commission and deposited
3333 as specified in Section 442.073, Government Code; and
3434 (3) an amount equal to 20 percent of the proceeds shall
3535 be credited to the General Land Office and deposited as specified in
3636 Section 33.604, Natural Resources Code.
3737 (c-1) The comptroller may not credit to the Parks and
3838 Wildlife Department, [or] the Texas Historical Commission, or the
3939 General Land Office any amounts under this section that are in
4040 excess of the amounts appropriated to the department, [or]
4141 commission, or office for that biennium, less any other amounts to
4242 which the department, [or] commission, or office is entitled.
4343 SECTION 3. This Act takes effect September 1, 2009.
