| 7 | 7 | | relating to the funding of certain activities of the General Land |
|---|
| 8 | 8 | | Office pertaining to the management of coastal public land. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 33.604(b), Natural Resources Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (b) The account consists of: |
|---|
| 13 | 13 | | (1) all money appropriated for the purposes of this |
|---|
| 14 | 14 | | subchapter; |
|---|
| 15 | 15 | | (2) grants to this state from the United States for the |
|---|
| 16 | 16 | | purposes of this subchapter; |
|---|
| 17 | 17 | | (3) all money received by this state from the sale of |
|---|
| 18 | 18 | | dredged material; [and] |
|---|
| 19 | 19 | | (4) penalties or costs collected under Section 61.0184 |
|---|
| 20 | 20 | | or 63.1814; and |
|---|
| 21 | 21 | | (5) credits made to the land office under Section |
|---|
| 22 | 22 | | 151.801, Tax Code. |
|---|
| 23 | 23 | | SECTION 2. Sections 151.801(c) and (c-1), Tax Code, are |
|---|
| 24 | 24 | | amended to read as follows: |
|---|
| 25 | 25 | | (c) Subject to Subsection (c-1), the proceeds from the |
|---|
| 26 | 26 | | collection of the taxes imposed by this chapter on the sale, |
|---|
| 27 | 27 | | storage, or use of sporting goods shall be deposited as follows: |
|---|
| 28 | 28 | | (1) an amount equal to 74 [94] percent of the proceeds |
|---|
| 29 | 29 | | shall be credited to the Parks and Wildlife Department and |
|---|
| 30 | 30 | | deposited as specified in the Parks and Wildlife Code; [and] |
|---|
| 31 | 31 | | (2) an amount equal to six percent of the proceeds |
|---|
| 32 | 32 | | shall be credited to the Texas Historical Commission and deposited |
|---|
| 33 | 33 | | as specified in Section 442.073, Government Code; and |
|---|
| 34 | 34 | | (3) an amount equal to 20 percent of the proceeds shall |
|---|
| 35 | 35 | | be credited to the General Land Office and deposited as specified in |
|---|
| 36 | 36 | | Section 33.604, Natural Resources Code. |
|---|
| 37 | 37 | | (c-1) The comptroller may not credit to the Parks and |
|---|
| 38 | 38 | | Wildlife Department, [or] the Texas Historical Commission, or the |
|---|
| 39 | 39 | | General Land Office any amounts under this section that are in |
|---|
| 40 | 40 | | excess of the amounts appropriated to the department, [or] |
|---|
| 41 | 41 | | commission, or office for that biennium, less any other amounts to |
|---|
| 42 | 42 | | which the department, [or] commission, or office is entitled. |
|---|
| 43 | 43 | | SECTION 3. This Act takes effect September 1, 2009. |
