44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the use of money from the Texas emerging technology fund
77 for the research and development of clean energy.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter C, Chapter 490, Government Code, is
1010 amended by adding Section 490.1027 to read as follows:
1111 Sec. 490.1027. USE OF MONEY FOR RESEARCH AND DEVELOPMENT OF
1212 CERTAIN ENERGY-RELATED INITIATIVES. (a) The governor, lieutenant
1313 governor, and speaker of the house of representatives shall ensure
1414 that all the money distributed from the fund for the state fiscal
1515 biennium beginning September 1, 2009, and ending August 31, 2011,
1616 less any amounts awarded for biotechnology, medicine, and life
1717 sciences during the biennium ending August 31, 2009, and less any
1818 amounts necessary to administer the fund under Section 490.055,
1919 will be used as provided by Subchapter D, E, or F for the research
2020 and development of:
2121 (1) low carbon fuels;
2222 (2) low carbon electric generation technologies
2323 including energy efficiency, renewable energy, and electricity
2424 storage; and
2525 (3) carbon emissions mitigation strategies.
2626 (b) To the extent of a conflict between this section and
2727 Section 490.302 or another provision of this chapter, this section
2828 controls.
2929 (c) This section expires January 1, 2012.
3030 SECTION 2. This Act takes effect immediately if it receives
3131 a vote of two-thirds of all the members elected to each house, as
3232 provided by Section 39, Article III, Texas Constitution. If this
3333 Act does not receive the vote necessary for immediate effect, this
3434 Act takes effect September 1, 2009.
