| 7 | 7 | | for the research and development of clean energy. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subchapter C, Chapter 490, Government Code, is |
|---|
| 10 | 10 | | amended by adding Section 490.1027 to read as follows: |
|---|
| 11 | 11 | | Sec. 490.1027. USE OF MONEY FOR RESEARCH AND DEVELOPMENT OF |
|---|
| 12 | 12 | | CERTAIN ENERGY-RELATED INITIATIVES. (a) The governor, lieutenant |
|---|
| 13 | 13 | | governor, and speaker of the house of representatives shall ensure |
|---|
| 14 | 14 | | that all the money distributed from the fund for the state fiscal |
|---|
| 15 | 15 | | biennium beginning September 1, 2009, and ending August 31, 2011, |
|---|
| 16 | 16 | | less any amounts awarded for biotechnology, medicine, and life |
|---|
| 17 | 17 | | sciences during the biennium ending August 31, 2009, and less any |
|---|
| 18 | 18 | | amounts necessary to administer the fund under Section 490.055, |
|---|
| 19 | 19 | | will be used as provided by Subchapter D, E, or F for the research |
|---|
| 20 | 20 | | and development of: |
|---|
| 21 | 21 | | (1) low carbon fuels; |
|---|
| 22 | 22 | | (2) low carbon electric generation technologies |
|---|
| 23 | 23 | | including energy efficiency, renewable energy, and electricity |
|---|
| 24 | 24 | | storage; and |
|---|
| 25 | 25 | | (3) carbon emissions mitigation strategies. |
|---|
| 26 | 26 | | (b) To the extent of a conflict between this section and |
|---|
| 27 | 27 | | Section 490.302 or another provision of this chapter, this section |
|---|
| 28 | 28 | | controls. |
|---|
| 29 | 29 | | (c) This section expires January 1, 2012. |
|---|
| 30 | 30 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 31 | 31 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 32 | 32 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 33 | 33 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 34 | 34 | | Act takes effect September 1, 2009. |
