| 8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 9 | 9 | SECTION 1. Section 105.01, Alcoholic Beverage Code, is | |
| 10 | 10 | amended to read as follows: | |
| 11 | 11 | Sec. 105.01. HOURS OF SALE: LIQUOR. (a) Except as | |
| 12 | 12 | provided by Subsection (c) or [in] Sections 105.02, 105.03, 105.04, | |
| 13 | 13 | and 105.08, no person may sell, offer for sale, or deliver any | |
| 14 | 14 | liquor: | |
| 15 | 15 | (1) on New Year's Day, Thanksgiving Day, or Christmas | |
| 16 | 16 | Day; | |
| 17 | 17 | (2) on Sunday; or | |
| 18 | 18 | (3) before 10 a.m. or after 9 p.m. on any other day. | |
| 19 | 19 | (b) When Christmas Day or New Year's Day falls on a Sunday, | |
| 20 | 20 | Subsection (a) of this section applies to the following Monday. | |
| 21 | 21 | (c) The holder of a package store permit for premises | |
| 22 | 22 | located in a county that borders the United Mexican States may sell | |
| 23 | 23 | or offer for sale liquor beginning at noon and ending at 9 p.m. on | |
| 24 | 24 | Sunday. | |
| 25 | 25 | SECTION 2. This Act takes effect September 1, 2009. |
