66 AN ACT
77 relating to the designation of highway safety corridors; providing
88 penalties.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. The heading to Section 201.905, Transportation
1111 Code, is amended to read as follows:
1212 Sec. 201.905. TRAFFIC SAFETY SIGNS; SAFETY CORRIDOR.
1313 SECTION 2. Section 201.905, Transportation Code, is amended
1414 by amending Subsection (b) and adding Subsections (c) and (d) to
1515 read as follows:
1616 (b) The department may designate a portion of a roadway
1717 containing a site described in Subsection (a) as a highway safety
1818 corridor. The department shall erect a sign at each end of the
1919 corridor and at appropriate intermediate sites along the corridor:
2020 (1) indicating that it is a highway safety corridor;
2121 and
2222 (2) stating "Fines double: highway safety corridor."
2323 (c) The department may include the information described in
2424 Subsections (a) and (b) on the same sign.
2525 (d) A program under this section may also include literature
2626 distributed to the public by the department.
2727 SECTION 3. Subchapter D, Chapter 542, Transportation Code,
2828 is amended by adding Section 542.4045 to read as follows:
2929 Sec. 542.4045. FINE FOR OFFENSE IN HIGHWAY SAFETY
3030 CORRIDOR. (a) If an offense under this subtitle, other than an
3131 offense under Chapter 548 or 552 or Section 545.412 or 545.413, is
3232 committed in a highway safety corridor:
3333 (1) the minimum fine applicable to the offense is
3434 twice the minimum fine that would be applicable to the offense if it
3535 were committed outside a highway safety corridor; and
3636 (2) the maximum fine applicable to the offense is
3737 twice the maximum fine that would be applicable to the offense if it
3838 were committed outside a highway safety corridor.
3939 (b) In this section, "highway safety corridor" has the
4040 meaning assigned by Section 201.905.
4141 SECTION 4. The change in law made by this Act applies only
4242 to an offense committed on or after the effective date of this Act.
4343 An offense committed before the effective date of this Act is
4444 covered by the law in effect immediately before the effective date
4545 of this Act, and the former law is continued in effect for that
4646 purpose. For purposes of this section, an offense was committed
4747 before the effective date of this Act if any element of the offense
4848 was committed before that date.
4949 SECTION 5. This Act takes effect September 1, 2009.
