| 8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 9 | 9 | SECTION 1. Section 111.96, Education Code, is amended to | |
| 10 | 10 | read as follows: | |
| 11 | 11 | Sec. 111.96. ESTABLISHMENT: SCOPE. (a) The board of | |
| 12 | 12 | regents shall maintain [establish] an [upper-level] educational | |
| 13 | 13 | institution in the City of Victoria to be known as the University of | |
| 14 | 14 | Houston-Victoria. | |
| 15 | 15 | (b) The institution shall [be organized to] offer | |
| 16 | 16 | undergraduate [only junior, senior,] and graduate level programs. | |
| 17 | 17 | [(c) The institution may enroll a student who has | |
| 18 | 18 | successfully completed at least 30 semester credit hours of course | |
| 19 | 19 | work at a public or private institution of higher education and who | |
| 20 | 20 | is concurrently enrolled in another public or private institution | |
| 21 | 21 | of higher education.] | |
| 22 | 22 | SECTION 2. This Act takes effect immediately if it receives | |
| 23 | 23 | a vote of two-thirds of all the members elected to each house, as | |
| 24 | 24 | provided by Section 39, Article III, Texas Constitution. If this | |
| 25 | 25 | Act does not receive the vote necessary for immediate effect, this | |
| 26 | 26 | Act takes effect September 1, 2009. |
