77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 716.101, Health and Safety Code, is
99 amended to read as follows:
1010 Sec. 716.101. UNIDENTIFIED HUMAN REMAINS. (a) Except as
1111 provided by Subsection (b), a [A] crematory establishment may not
1212 accept for cremation unidentified human remains.
1313 (b) Notwithstanding any other provision of this chapter, a
1414 crematory establishment may accept for cremation unidentified
1515 human remains from a county on the order of:
1616 (1) the county commissioners court; or
1717 (2) a court located in the county.
1818 SECTION 2. This Act takes effect immediately if it receives
1919 a vote of two-thirds of all the members elected to each house, as
2020 provided by Section 39, Article III, Texas Constitution. If this
2121 Act does not receive the vote necessary for immediate effect, this
2222 Act takes effect September 1, 2009.
