| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 716.101, Health and Safety Code, is |
|---|
| 9 | 9 | | amended to read as follows: |
|---|
| 10 | 10 | | Sec. 716.101. UNIDENTIFIED HUMAN REMAINS. (a) Except as |
|---|
| 11 | 11 | | provided by Subsection (b), a [A] crematory establishment may not |
|---|
| 12 | 12 | | accept for cremation unidentified human remains. |
|---|
| 13 | 13 | | (b) Notwithstanding any other provision of this chapter, a |
|---|
| 14 | 14 | | crematory establishment may accept for cremation unidentified |
|---|
| 15 | 15 | | human remains from a county on the order of: |
|---|
| 16 | 16 | | (1) the county commissioners court; or |
|---|
| 17 | 17 | | (2) a court located in the county. |
|---|
| 18 | 18 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 19 | 19 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 20 | 20 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 21 | 21 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 22 | 22 | | Act takes effect September 1, 2009. |
