66 AN ACT
77 relating to the penalty for failure to yield the right-of-way.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 545.153, Transportation Code, is amended
1010 by adding Subsection (e) to read as follows:
1111 (e) If it is shown on the trial of an offense under this
1212 section that as a result of the commission of the offense an
1313 accident causing injury to or the death of a pedestrian occurred:
1414 (1) the minimum fine applicable to the offense is
1515 twice the minimum fine that would otherwise be applicable to the
1616 offense; and
1717 (2) the maximum fine applicable to the offense is
1818 twice the maximum fine that would otherwise be applicable to the
1919 offense.
2020 SECTION 2. (a) The change in law made by this Act applies
2121 only to an offense committed on or after the effective date of this
2222 Act. For purposes of this section, an offense is committed before
2323 the effective date of this Act if any element of the offense occurs
2424 before that date.
2525 (b) An offense committed before the effective date of this
2626 Act is covered by the law in effect when the offense was committed,
2727 and the former law is continued in effect for that purpose.
2828 SECTION 3. This Act takes effect September 1, 2009.
