8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Section 545.153, Transportation Code, is amended | |
10 | 10 | by adding Subsection (e) to read as follows: | |
11 | 11 | (e) If it is shown on the trial of an offense under this | |
12 | 12 | section that as a result of the commission of the offense an | |
13 | 13 | accident causing injury to or the death of a pedestrian occurred: | |
14 | 14 | (1) the minimum fine applicable to the offense is | |
15 | 15 | twice the minimum fine that would otherwise be applicable to the | |
16 | 16 | offense; and | |
17 | 17 | (2) the maximum fine applicable to the offense is | |
18 | 18 | twice the maximum fine that would otherwise be applicable to the | |
19 | 19 | offense. | |
20 | 20 | SECTION 2. (a) The change in law made by this Act applies | |
21 | 21 | only to an offense committed on or after the effective date of this | |
22 | 22 | Act. For purposes of this section, an offense is committed before | |
23 | 23 | the effective date of this Act if any element of the offense occurs | |
24 | 24 | before that date. | |
25 | 25 | (b) An offense committed before the effective date of this | |
26 | 26 | Act is covered by the law in effect when the offense was committed, | |
27 | 27 | and the former law is continued in effect for that purpose. | |
28 | 28 | SECTION 3. This Act takes effect September 1, 2009. |
