6 | 6 | | relating to training for employees and operators of certain |
---|
7 | 7 | | child-care facilities. |
---|
8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Section 42.0421, Human Resources Code, is |
---|
10 | 10 | | amended by adding Subsections (e) and (f) to read as follows: |
---|
11 | 11 | | (e) The training required by this section must be |
---|
12 | 12 | | appropriately targeted and relevant to the age of the children who |
---|
13 | 13 | | will receive care from the individual receiving training and must |
---|
14 | 14 | | be provided by a person who: |
---|
15 | 15 | | (1) is a training provider registered with the Texas |
---|
16 | 16 | | Early Care and Education Career Development System's Texas Trainer |
---|
17 | 17 | | Registry that is maintained by the Texas Head Start State |
---|
18 | 18 | | Collaboration Office; |
---|
19 | 19 | | (2) is an instructor at a public or private secondary |
---|
20 | 20 | | school or at a public or private institution of higher education, as |
---|
21 | 21 | | defined by Section 61.801, Education Code, who teaches early |
---|
22 | 22 | | childhood development or another relevant course, as determined by |
---|
23 | 23 | | rules adopted by the commissioner of education and the commissioner |
---|
24 | 24 | | of higher education; |
---|
25 | 25 | | (3) is an employee of a state agency with relevant |
---|
26 | 26 | | expertise; |
---|
27 | 27 | | (4) is a physician, psychologist, licensed |
---|
28 | 28 | | professional counselor, social worker, or registered nurse; |
---|
29 | 29 | | (5) holds a generally recognized credential or |
---|
30 | 30 | | possesses documented knowledge relevant to the training the person |
---|
31 | 31 | | will provide; |
---|
32 | 32 | | (6) is a registered family home care provider or |
---|
33 | 33 | | director of a day-care center or group day-care home in good |
---|
34 | 34 | | standing with the department, if applicable, and who: |
---|
35 | 35 | | (A) has demonstrated core knowledge in child |
---|
36 | 36 | | development and caregiving; and |
---|
37 | 37 | | (B) is only providing training at the home or |
---|
38 | 38 | | center in which the provider or director and the person receiving |
---|
39 | 39 | | training are employed; or |
---|
40 | 40 | | (7) has at least two years of experience working in |
---|
41 | 41 | | child development or early childhood education and: |
---|
42 | 42 | | (A) has been awarded a child development |
---|
43 | 43 | | associate (CDA) credential; or |
---|
44 | 44 | | (B) holds an associate's degree in child |
---|
45 | 45 | | development, early childhood education, or a related field. |
---|
46 | 46 | | (f) A person described by Subsection (e)(6) may provide |
---|
47 | 47 | | training under this section only if the department has not taken an |
---|
48 | 48 | | action under Section 42.071, 42.072, or 42.078, other than an |
---|
49 | 49 | | evaluation, against the license, listing, or registration of the |
---|
50 | 50 | | person or the home or center for which the person is a provider or |
---|
51 | 51 | | director during the two-year period preceding the date on which the |
---|
52 | 52 | | person provides the training. |
---|
53 | 53 | | SECTION 2. This Act takes effect January 1, 2010. |
