44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to training for employees and operators of certain
77 child-care facilities.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 42.0421, Human Resources Code, is
1010 amended by adding Subsections (e) and (f) to read as follows:
1111 (e) The training required by this section must be
1212 appropriately targeted and relevant to the age of the children who
1313 will receive care from the individual receiving training and must
1414 be provided by a person who:
1515 (1) is a training provider registered with the Texas
1616 Early Care and Education Career Development System's Texas Trainer
1717 Registry that is maintained by the Texas Head Start State
1818 Collaboration Office;
1919 (2) is an instructor at a public or private secondary
2020 school or at a public or private institution of higher education, as
2121 defined by Section 61.801, Education Code, who teaches early
2222 childhood development or another relevant course, as determined by
2323 rules adopted by the commissioner of education and the commissioner
2424 of higher education;
2525 (3) is an employee of a state agency with relevant
2626 expertise;
2727 (4) is a physician, psychologist, licensed
2828 professional counselor, social worker, or registered nurse;
2929 (5) holds a generally recognized credential or
3030 possesses documented knowledge relevant to the training the person
3131 will provide;
3232 (6) is a registered family home care provider or
3333 director of a day-care center or group day-care home in good
3434 standing with the department, if applicable, and who:
3535 (A) has demonstrated core knowledge in child
3636 development and caregiving; and
3737 (B) is only providing training at the home or
3838 center in which the provider or director and the person receiving
3939 training are employed; or
4040 (7) has at least two years of experience working in
4141 child development or early childhood education and:
4242 (A) has been awarded a child development
4343 associate (CDA) credential; or
4444 (B) holds an associate's degree in child
4545 development, early childhood education, or a related field.
4646 (f) A person described by Subsection (e)(6) may provide
4747 training under this section only if the department has not taken an
4848 action under Section 42.071, 42.072, or 42.078, other than an
4949 evaluation, against the license, listing, or registration of the
5050 person or the home or center for which the person is a provider or
5151 director during the two-year period preceding the date on which the
5252 person provides the training.
5353 SECTION 2. This Act takes effect January 1, 2010.
