66 AN ACT
77 relating to an exemption from the sales tax for certain renewable
88 energy devices and manufacturing equipment.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 151.318, Tax Code, is amended by adding
1111 Subsection (u) to read as follows:
1212 (u) In addition to the other items exempted under this
1313 section, all equipment necessary for the production or manufacture
1414 of photovoltaic renewable energy devices, including equipment
1515 described by Subsections (c) and (e), is exempted from the taxes
1616 imposed by this chapter. In this subsection, "photovoltaic
1717 renewable energy device" means a device and related components that
1818 naturally generate or regenerate over a short period electric
1919 energy that is derived directly or indirectly from the sun.
2020 SECTION 2. Subchapter H, Chapter 151, Tax Code, is amended
2121 by adding Section 151.3332 to read as follows:
2222 Sec. 151.3332. PHOTOVOLTAIC RENEWABLE ENERGY DEVICES. (a)
2323 In this section:
2424 (1) "Photovoltaic renewable energy device" has the
2525 meaning assigned by Section 151.318(u).
2626 (2) "Retail customer" has the meaning assigned by
2727 Section 31.002, Utilities Code.
2828 (b) The sale, use, installation, construction, assembly,
2929 maintenance, or other consumption of a photovoltaic renewable
3030 energy device that is connected or placed on a retail customer's
3131 side of the meter is exempted from the taxes imposed by this
3232 chapter.
3333 SECTION 3. The change in law made by this Act does not
3434 affect a tax liability accruing before the effective date of this
3535 Act. That liability continues in effect as if this Act had not been
3636 enacted, and the former law is continued in effect for the
3737 collection of taxes due and for civil and criminal enforcement of
3838 the liability for those taxes.
3939 SECTION 4. This Act takes effect July 1, 2009, if it
4040 receives a vote of two-thirds of all members elected to each house,
4141 as provided by Section 39, Article III, Texas Constitution. If this
4242 Act does not receive the vote necessary for effect on that date,
4343 this Act takes effect September 1, 2009.
