55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to enrollment requirements for the operation of Texas A&M
88 University--San Antonio as a general academic teaching institution
99 and the issuance of bonds for that institution.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subsection (d), Section 87.841, Education Code,
1212 is amended to read as follows:
1313 (d) Notwithstanding any other provision of this subchapter,
1414 Texas A&M University--San Antonio may not operate as a general
1515 academic teaching institution until the Texas Higher Education
1616 Coordinating Board certifies that enrollment at the Texas A&M
1717 University--Kingsville System Center--San Antonio has reached an
1818 enrollment equivalent of[:
1919 [(1)] 1,000 full-time students for one semester [if
2020 the legislature authorizes revenue bonds to be issued to finance
2121 educational and related facilities for the institution, and the
2222 bonds are issued for that purpose; or
2323 [(2) 2,500 full-time students for one semester if the
2424 conditions specified by Subdivision (1) are not satisfied].
2525 SECTION 2. Subsection (e), Section 55.1751, Education Code,
2626 is amended to read as follows:
2727 (e) Notwithstanding Subsection (a), The Texas A&M
2828 University System may not issue bonds under this section for
2929 facilities at Texas A&M University--San Antonio until the Texas
3030 Higher Education Coordinating Board certifies that enrollment at
3131 Texas A&M University--San Antonio has reached an enrollment
3232 equivalent of 1,000 [1,500] full-time students for one
3333 semester. [If that enrollment is not reached by January 1, 2010,
3434 the system's authority to issue bonds for Texas A&M University--San
3535 Antonio under this section expires on that date.]
3636 SECTION 3. This Act takes effect immediately if it receives
3737 a vote of two-thirds of all the members elected to each House, as
3838 provided by Section 39, Article III, Texas Constitution. If this
3939 Act does not receive the vote necessary for immediate effect, this
4040 Act takes effect September 1, 2009.
