55 AN ACT
66 relating to examination requirements for certain applicants for a
77 license to practice medicine.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 155.051, Occupations Code, is amended by
1010 adding Subsections (d) and (e) to read as follows:
1111 (d) The time frame to pass each part of the examination does
1212 not apply to an applicant who:
1313 (1) is licensed and in good standing as a physician in
1414 another state;
1515 (2) has been licensed for at least five years;
1616 (3) does not hold a medical license in the other state
1717 that has or has ever had any restrictions, disciplinary orders, or
1818 probation; and
1919 (4) will practice in a medically underserved area or a
2020 health manpower shortage area, as those terms are defined by
2121 Section 157.052.
2222 (e) The board may by rule establish a process to verify that
2323 a person, after meeting the requirements of Subsection (d),
2424 practices only in an area described by Subsection (d)(4).
2525 SECTION 2. Section 155.056, Occupations Code, is amended by
2626 adding Subsections (e) and (f) to read as follows:
2727 (e) The limitation on examination attempts by an applicant
2828 under Subsection (a) does not apply to an applicant who:
2929 (1) is licensed and in good standing as a physician in
3030 another state;
3131 (2) has been licensed for at least five years;
3232 (3) does not hold a medical license in the other state
3333 that has or has ever had any restrictions, disciplinary orders, or
3434 probation; and
3535 (4) will practice in a medically underserved area or a
3636 health manpower shortage area, as those terms are defined by
3737 Section 157.052.
3838 (f) The board may by rule establish a process to verify that
3939 a person who, after meeting the requirements of Subsection (e),
4040 practices only in an area described by Subsection (e)(4).
4141 SECTION 3. This Act takes effect immediately if it receives
4242 a vote of two-thirds of all the members elected to each house, as
4343 provided by Section 39, Article III, Texas Constitution. If this
4444 Act does not receive the vote necessary for immediate effect, this
4545 Act takes effect September 1, 2009.
