| 6 | 6 | | relating to examination requirements for certain applicants for a |

| 7 | 7 | | license to practice medicine. |
|---|
| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 155.051, Occupations Code, is amended by |
|---|
| 10 | 10 | | adding Subsections (d) and (e) to read as follows: |
|---|
| 11 | 11 | | (d) The time frame to pass each part of the examination does |
|---|
| 12 | 12 | | not apply to an applicant who: |
|---|
| 13 | 13 | | (1) is licensed and in good standing as a physician in |
|---|
| 14 | 14 | | another state; |
|---|
| 15 | 15 | | (2) has been licensed for at least five years; |
|---|
| 16 | 16 | | (3) does not hold a medical license in the other state |
|---|
| 17 | 17 | | that has or has ever had any restrictions, disciplinary orders, or |
|---|
| 18 | 18 | | probation; and |
|---|
| 19 | 19 | | (4) will practice in a medically underserved area or a |
|---|
| 20 | 20 | | health manpower shortage area, as those terms are defined by |
|---|
| 21 | 21 | | Section 157.052. |
|---|
| 22 | 22 | | (e) The board may by rule establish a process to verify that |
|---|
| 23 | 23 | | a person, after meeting the requirements of Subsection (d), |
|---|
| 24 | 24 | | practices only in an area described by Subsection (d)(4). |

| 25 | 25 | | SECTION 2. Section 155.056, Occupations Code, is amended by |
|---|
| 26 | 26 | | adding Subsections (e) and (f) to read as follows: |
|---|
| 27 | 27 | | (e) The limitation on examination attempts by an applicant |
|---|
| 28 | 28 | | under Subsection (a) does not apply to an applicant who: |
|---|
| 29 | 29 | | (1) is licensed and in good standing as a physician in |
|---|
| 30 | 30 | | another state; |
|---|
| 31 | 31 | | (2) has been licensed for at least five years; |
|---|
| 32 | 32 | | (3) does not hold a medical license in the other state |
|---|
| 33 | 33 | | that has or has ever had any restrictions, disciplinary orders, or |
|---|
| 34 | 34 | | probation; and |
|---|
| 35 | 35 | | (4) will practice in a medically underserved area or a |
|---|
| 36 | 36 | | health manpower shortage area, as those terms are defined by |

| 41 | 41 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 42 | 42 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 43 | 43 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 44 | 44 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 45 | 45 | | Act takes effect September 1, 2009. |
