66 AN ACT
77 relating to the use of net metering by certain electric utilities.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 39.107, Utilities Code, is amended by
1010 amending Subsection (i), as added by Chapter 939 (H.B. 3693), Acts
1111 of the 80th Legislature, Regular Session, 2007, and adding
1212 Subsection (k) to read as follows:
1313 (i) Subject to the restrictions in Subsection (h), it is the
1414 intent of the legislature that [net metering and] advanced meter
1515 information networks be deployed as rapidly as possible to allow
1616 customers to better manage energy use and control costs, and to
1717 facilitate demand response initiatives.
1818 (k) Notwithstanding any other law, the commission shall
1919 adopt rules and standards under which a retail electric provider,
2020 electric cooperative, municipally owned utility, or transmission
2121 and distribution utility shall offer net metering service as
2222 defined by the federal Public Utility Regulatory Policies Act of
2323 1978 (16 U.S.C. Section 2621(d)(11)) to all residential customers
2424 as soon as practicable but not later than January 1, 2010.
2525 SECTION 2. This Act takes effect immediately if it receives
2626 a vote of two-thirds of all the members elected to each house, as
2727 provided by Section 39, Article III, Texas Constitution. If this
2828 Act does not receive the vote necessary for immediate effect, this
2929 Act takes effect September 1, 2009.
