| 7 | 7 | | relating to insurance coverage for certain devices that facilitate |
|---|
| 8 | 8 | | insulin therapy and enhance glucose control in the treatment of |
|---|
| 9 | 9 | | diabetes. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Sections 1358.051(1) and (2), Insurance Code, |
|---|
| 12 | 12 | | are amended to read as follows: |
|---|
| 13 | 13 | | (1) "Diabetes equipment" means: |
|---|
| 14 | 14 | | (A) blood glucose monitors, including |
|---|
| 15 | 15 | | noninvasive glucose monitors and glucose monitors designed to be |
|---|
| 16 | 16 | | used by blind individuals; |
|---|
| 17 | 17 | | (B) insulin pumps and associated appurtenances; |
|---|
| 18 | 18 | | (C) insulin infusion devices and devices that |
|---|
| 19 | 19 | | facilitate insulin therapy and enhance glucose control; and |
|---|
| 20 | 20 | | (D) podiatric appliances for the prevention of |
|---|
| 21 | 21 | | complications associated with diabetes. |
|---|
| 22 | 22 | | (2) "Diabetes supplies" means: |
|---|
| 23 | 23 | | (A) test strips for blood glucose monitors; |
|---|
| 24 | 24 | | (B) visual reading and urine test strips; |
|---|
| 25 | 25 | | (C) lancets and lancet devices; |
|---|
| 26 | 26 | | (D) insulin and insulin analogs; |
|---|
| 27 | 27 | | (E) injection aids and devices that facilitate |
|---|
| 28 | 28 | | insulin therapy and enhance glucose control; |
|---|
| 29 | 29 | | (F) syringes; |
|---|
| 30 | 30 | | (G) prescriptive and nonprescriptive oral agents |
|---|
| 31 | 31 | | for controlling blood sugar levels; and |
|---|
| 32 | 32 | | (H) glucagon emergency kits. |
|---|
| 33 | 33 | | SECTION 2. This Act applies only to an insurance policy that |
|---|
| 34 | 34 | | is delivered, issued for delivery, or renewed on or after January 1, |
|---|
| 35 | 35 | | 2010. A policy delivered, issued for delivery, or renewed before |
|---|
| 36 | 36 | | January 1, 2010, is governed by the law as it existed immediately |
|---|
| 37 | 37 | | before the effective date of this Act, and that law is continued in |
|---|
| 38 | 38 | | effect for that purpose. |
|---|
| 39 | 39 | | SECTION 3. This Act takes effect September 1, 2009. |
