66 AN ACT
77 relating to insurance coverage for certain devices that facilitate
88 insulin therapy and enhance glucose control in the treatment of
99 diabetes.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Sections 1358.051(1) and (2), Insurance Code,
1212 are amended to read as follows:
1313 (1) "Diabetes equipment" means:
1414 (A) blood glucose monitors, including
1515 noninvasive glucose monitors and glucose monitors designed to be
1616 used by blind individuals;
1717 (B) insulin pumps and associated appurtenances;
1818 (C) insulin infusion devices and devices that
1919 facilitate insulin therapy and enhance glucose control; and
2020 (D) podiatric appliances for the prevention of
2121 complications associated with diabetes.
2222 (2) "Diabetes supplies" means:
2323 (A) test strips for blood glucose monitors;
2424 (B) visual reading and urine test strips;
2525 (C) lancets and lancet devices;
2626 (D) insulin and insulin analogs;
2727 (E) injection aids and devices that facilitate
2828 insulin therapy and enhance glucose control;
2929 (F) syringes;
3030 (G) prescriptive and nonprescriptive oral agents
3131 for controlling blood sugar levels; and
3232 (H) glucagon emergency kits.
3333 SECTION 2. This Act applies only to an insurance policy that
3434 is delivered, issued for delivery, or renewed on or after January 1,
3535 2010. A policy delivered, issued for delivery, or renewed before
3636 January 1, 2010, is governed by the law as it existed immediately
3737 before the effective date of this Act, and that law is continued in
3838 effect for that purpose.
3939 SECTION 3. This Act takes effect September 1, 2009.
