55 relating to certain peace officers commissioned by the Texas State

77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Subsection (b), Section 554.010, Occupations
99 Code, is amended to read as follows:
1010 (b) An employee commissioned as a peace officer under this
1111 subtitle has the powers, privileges, and immunities of a peace
1212 officer while carrying out duties as a peace officer under this
1313 subtitle[, except that the employee may not carry a firearm or make
1414 an arrest].
1515 SECTION 2. This Act takes effect immediately if it receives
1616 a vote of two-thirds of all the members elected to each house, as
1717 provided by Section 39, Article III, Texas Constitution. If this
1818 Act does not receive the vote necessary for immediate effect, this
1919 Act takes effect September 1, 2009.
