| 8 | 8 | | through the Public Education Information Management System |

| 9 | 9 | | (PEIMS). |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 42.006(c), Education Code, is amended to |
|---|
| 12 | 12 | | read as follows: |
|---|
| 13 | 13 | | (c) Annually, the commissioner shall review the Public |
|---|
| 14 | 14 | | Education Information Management System and shall repeal or amend |
|---|
| 15 | 15 | | rules that require school districts to provide information through |
|---|
| 16 | 16 | | the Public Education Information Management System that is not |
|---|
| 17 | 17 | | necessary. In reviewing and revising the Public Education |
|---|
| 18 | 18 | | Information Management System, the commissioner shall develop |
|---|
| 19 | 19 | | rules to ensure that the system: |
|---|
| 20 | 20 | | (1) provides useful, accurate, and timely information |
|---|
| 21 | 21 | | on student demographics and academic performance, including |
|---|
| 22 | 22 | | numerical grades earned in a class or course, personnel, and school |
|---|
| 23 | 23 | | district finances; |
|---|
| 24 | 24 | | (2) contains only the data necessary for the |
|---|
| 25 | 25 | | legislature and the agency to perform their legally authorized |
|---|
| 26 | 26 | | functions in overseeing the public education system; and |
|---|
| 27 | 27 | | (3) does not contain any information related to |
|---|
| 28 | 28 | | instructional methods, except as provided by Section 29.066 or |
|---|
| 29 | 29 | | required by federal law. |
|---|
| 30 | 30 | | SECTION 2. This Act applies beginning with the 2009-2010 |
|---|
| 31 | 31 | | school year. |
|---|
| 32 | 32 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 33 | 33 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 34 | 34 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 35 | 35 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 36 | 36 | | Act takes effect September 1, 2009. |
