66 AN ACT
77 relating to the student academic performance information provided
88 through the Public Education Information Management System
99 (PEIMS).
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 42.006(c), Education Code, is amended to
1212 read as follows:
1313 (c) Annually, the commissioner shall review the Public
1414 Education Information Management System and shall repeal or amend
1515 rules that require school districts to provide information through
1616 the Public Education Information Management System that is not
1717 necessary. In reviewing and revising the Public Education
1818 Information Management System, the commissioner shall develop
1919 rules to ensure that the system:
2020 (1) provides useful, accurate, and timely information
2121 on student demographics and academic performance, including
2222 numerical grades earned in a class or course, personnel, and school
2323 district finances;
2424 (2) contains only the data necessary for the
2525 legislature and the agency to perform their legally authorized
2626 functions in overseeing the public education system; and
2727 (3) does not contain any information related to
2828 instructional methods, except as provided by Section 29.066 or
2929 required by federal law.
3030 SECTION 2. This Act applies beginning with the 2009-2010
3131 school year.
3232 SECTION 3. This Act takes effect immediately if it receives
3333 a vote of two-thirds of all the members elected to each house, as
3434 provided by Section 39, Article III, Texas Constitution. If this
3535 Act does not receive the vote necessary for immediate effect, this
3636 Act takes effect September 1, 2009.
