6 | 6 | | relating to the use of certain state parking facilities, including |

7 | 7 | | the lease of the facilities, to other persons. |

8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. The heading to Section 2165.2035, Government |
---|
10 | 10 | | Code, is amended to read as follows: |
---|
11 | 11 | | Sec. 2165.2035. LEASE OF SPACE IN STATE-OWNED PARKING LOTS |
---|
12 | 12 | | AND GARAGES; USE AFTER HOURS. |
---|
13 | 13 | | SECTION 2. Subchapter E, Chapter 2165, Government Code, is |
---|
14 | 14 | | amended by adding Sections 2165.204 and 2165.2045 to read as |
---|
15 | 15 | | follows: |
---|
16 | 16 | | Sec. 2165.204. LEASE OF SPACE IN STATE-OWNED PARKING LOTS |
---|
17 | 17 | | AND GARAGES; EXCESS INDIVIDUAL PARKING SPACES. (a) The commission |
---|
18 | 18 | | may lease to a private individual an individual parking space in a |
---|
19 | 19 | | state-owned parking lot or garage located in the city of Austin that |
---|
20 | 20 | | the commission determines is not needed to accommodate the regular |
---|
21 | 21 | | parking requirements of state employees who work near the lot or |
---|
22 | 22 | | garage and visitors to nearby state government offices. |
---|
23 | 23 | | (b) Money received from a lease under this section shall be |
---|
24 | 24 | | deposited to the credit of the general revenue fund. |
---|
25 | 25 | | (c) On or before December 1 of each even-numbered year, the |
---|
26 | 26 | | commission shall submit a report to the legislature and the |
---|
27 | 27 | | Legislative Budget Board describing the effectiveness of the |
---|
28 | 28 | | program under this section. |
---|
29 | 29 | | Sec. 2165.2045. LEASE OF SPACE IN STATE-OWNED PARKING LOTS |
---|
30 | 30 | | AND GARAGES; EXCESS BLOCKS OF PARKING SPACE. (a) The commission |
---|
31 | 31 | | may lease to an institution of higher education or a local |
---|
32 | 32 | | government all or a significant block of a state-owned parking lot |
---|
33 | 33 | | or garage located in the city of Austin that the commission |
---|
34 | 34 | | determines is not needed to accommodate the regular parking |
---|
35 | 35 | | requirements of state employees who work near the lot or garage and |
---|
36 | 36 | | visitors to nearby state government offices. |
---|
37 | 37 | | (b) Money received from a lease under this section shall be |
---|
38 | 38 | | deposited to the credit of the general revenue fund. |
---|
39 | 39 | | (c) On or before December 1 of each even-numbered year, the |

43 | 43 | | SECTION 3. (a) In this section, "commission" means the |
---|
44 | 44 | | Texas Facilities Commission. |
---|
45 | 45 | | (b) The commission shall conduct a study on the actual usage |
---|
46 | 46 | | of state parking facilities by state employees. In conducting the |
---|
47 | 47 | | study, the commission shall: |
---|
48 | 48 | | (1) for each state parking facility under the |
---|
49 | 49 | | commission's charge and control, consider the: |
---|
50 | 50 | | (A) available parking capacity of the facility; |
---|
51 | 51 | | (B) number of state employees using the facility; |
---|
52 | 52 | | (C) number of visitors using the facility; |
---|
53 | 53 | | (D) amount and nature of revenue realized from |
---|
54 | 54 | | the facility; and |
---|
55 | 55 | | (E) excess capacity available within the |
---|
56 | 56 | | facility; and |
---|
57 | 57 | | (2) develop recommendations for the redevelopment of |
---|
58 | 58 | | significantly underused parking facilities to purposes more suited |
---|
59 | 59 | | to the efficient administration of state government. |
---|
60 | 60 | | (c) Not later than September 1, 2010, the commission shall |
---|
61 | 61 | | report the results of the study conducted under this section to the |
---|
62 | 62 | | governor and the Legislative Budget Board. |
---|
63 | 63 | | (d) This section expires January 1, 2011. |
---|
64 | 64 | | SECTION 4. This Act takes effect immediately if it receives |
---|
65 | 65 | | a vote of two-thirds of all the members elected to each house, as |
---|
66 | 66 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
67 | 67 | | Act does not receive the vote necessary for immediate effect, this |
---|
68 | 68 | | Act takes effect September 1, 2009. |
