66 relating to the use of certain state parking facilities, including
77 the lease of the facilities, to other persons.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. The heading to Section 2165.2035, Government
1010 Code, is amended to read as follows:
1111 Sec. 2165.2035. LEASE OF SPACE IN STATE-OWNED PARKING LOTS
1212 AND GARAGES; USE AFTER HOURS.
1313 SECTION 2. Subchapter E, Chapter 2165, Government Code, is
1414 amended by adding Sections 2165.204 and 2165.2045 to read as
1515 follows:
1616 Sec. 2165.204. LEASE OF SPACE IN STATE-OWNED PARKING LOTS
1717 AND GARAGES; EXCESS INDIVIDUAL PARKING SPACES. (a) The commission
1818 may lease to a private individual an individual parking space in a
1919 state-owned parking lot or garage located in the city of Austin that
2020 the commission determines is not needed to accommodate the regular
2121 parking requirements of state employees who work near the lot or
2222 garage and visitors to nearby state government offices.
2323 (b) Money received from a lease under this section shall be
2424 deposited to the credit of the general revenue fund.
2525 (c) On or before December 1 of each even-numbered year, the
2626 commission shall submit a report to the legislature and the
2727 Legislative Budget Board describing the effectiveness of the
2828 program under this section.
2929 Sec. 2165.2045. LEASE OF SPACE IN STATE-OWNED PARKING LOTS
3030 AND GARAGES; EXCESS BLOCKS OF PARKING SPACE. (a) The commission
3131 may lease to an institution of higher education or a local
3232 government all or a significant block of a state-owned parking lot
3333 or garage located in the city of Austin that the commission
3434 determines is not needed to accommodate the regular parking
3535 requirements of state employees who work near the lot or garage and
3636 visitors to nearby state government offices.
3737 (b) Money received from a lease under this section shall be
3838 deposited to the credit of the general revenue fund.
3939 (c) On or before December 1 of each even-numbered year, the
4040 commission shall submit a report to the legislature and the
4141 Legislative Budget Board describing the effectiveness of the
4242 program under this section.
4343 SECTION 3. (a) In this section, "commission" means the
4444 Texas Facilities Commission.
4545 (b) The commission shall conduct a study on the actual usage
4646 of state parking facilities by state employees. In conducting the
4747 study, the commission shall:
4848 (1) for each state parking facility under the
4949 commission's charge and control, consider the:
5050 (A) available parking capacity of the facility;
5151 (B) number of state employees using the facility;
5252 (C) number of visitors using the facility;
5353 (D) amount and nature of revenue realized from
5454 the facility; and
5555 (E) excess capacity available within the
5656 facility; and
5757 (2) develop recommendations for the redevelopment of
5858 significantly underused parking facilities to purposes more suited
5959 to the efficient administration of state government.
6060 (c) Not later than September 1, 2010, the commission shall
6161 report the results of the study conducted under this section to the
6262 governor and the Legislative Budget Board.
6363 (d) This section expires January 1, 2011.
6464 SECTION 4. This Act takes effect immediately if it receives
6565 a vote of two-thirds of all the members elected to each house, as
6666 provided by Section 39, Article III, Texas Constitution. If this
6767 Act does not receive the vote necessary for immediate effect, this
6868 Act takes effect September 1, 2009.
