The bill would amend the Government Code by adding Section 531.0105, which provides that a health and human services agency may grant leave with pay while the agency awaits the results of a criminal background check on the employee. The number of days an employee may be granted leave with pay for this purpose may not exceed 30 days during a state fiscal biennium, but may be extended by the executive commissioner for good cause, as defined by the bill.The bill would take effect September 1, 2009. It is assumed that any cost resulting from the passage of the bill could be reasonably absorbed within current resources.
