99 AN ACT
1010 relating to late fees under a residential lease.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subsection (a), Section 92.019, Property Code,
1313 is amended to read as follows:
1414 (a) A landlord may not charge a tenant a late fee for failing
1515 to pay rent unless:
1616 (1) notice of the fee is included in a written lease;
1717 (2) the fee is a reasonable estimate of uncertain
1818 damages to the landlord that are incapable of precise calculation
1919 and result from late payment of rent; and
2020 (3) the rent has remained [remains] unpaid one full
2121 [after the second] day after the date the rent was originally due.
2222 SECTION 2. This Act takes effect immediately if it receives
2323 a vote of two-thirds of all the members elected to each house, as
2424 provided by Section 39, Article III, Texas Constitution. If this
2525 Act does not receive the vote necessary for immediate effect, this
2626 Act takes effect September 1, 2009.
