55 relating to the sale of certain alcoholic beverages to private club
66 registration permit holders.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 19.01, Alcoholic Beverage Code, is
99 amended to read as follows:
1010 Sec. 19.01. AUTHORIZED ACTIVITIES. The holder of a
1111 wholesaler's permit may:
1212 (1) purchase and import liquor from distillers,
1313 brewers, wineries, wine bottlers, rectifiers, and manufacturers
1414 who are holders of nonresident seller's permits or from their
1515 agents who hold manufacturer's agents permits;
1616 (2) purchase liquor from other wholesalers in the
1717 state;
1818 (3) sell liquor in the original containers in which it
1919 is received to retailers and wholesalers in this state authorized
2020 to sell the liquor; [and]
2121 (4) sell liquor to qualified persons outside the
2222 state; and
2323 (5) sell ale and malt liquor to a holder of a private
2424 club registration permit.
2525 SECTION 2. Section 20.01, Alcoholic Beverage Code, is
2626 amended to read as follows:
2727 Sec. 20.01. AUTHORIZED ACTIVITIES. The holder of a general
2828 class B wholesaler's permit may:
2929 (1) purchase and import malt and vinous liquors from
3030 brewers, wineries, rectifiers, and wine manufacturers and wine
3131 bottlers who are the holders of nonresident seller's permits or
3232 their agents who are holders of manufacturer's agent permits;
3333 (2) purchase malt and vinous liquors from holders of
3434 brewer's permits or other wholesalers in the state;
3535 (3) sell the malt and vinous liquors in the original
3636 containers in which they are received to retailers and wholesalers
3737 authorized to sell them in this state, including holders of local
3838 distributor's permits, mixed beverage permits, and daily temporary
3939 mixed beverage permits; [and]
4040 (4) sell the malt and vinous liquors to qualified
4141 persons outside the state; and
4242 (5) sell ale and malt liquor to a holder of a private
4343 club registration permit.
4444 SECTION 3. Section 21.01, Alcoholic Beverage Code, is
4545 amended to read as follows:
4646 Sec. 21.01. AUTHORIZED ACTIVITIES. The holder of a local
4747 class B wholesaler's permit may:
4848 (1) purchase and import malt and vinous liquors from
4949 brewers, wineries, rectifiers, and wine manufacturers and bottlers
5050 who are holders of nonresident seller's permits and from their
5151 agents who are holders of manufacturer's agent permits;
5252 (2) purchase malt and vinous liquors from holders of
5353 brewer's permits and from other wholesalers in the state; [and]
5454 (3) sell the malt and vinous liquors, in the original
5555 containers in which he receives them, to general and local class B
5656 wholesaler's permittees and, in his county of residence, to local
5757 distributor's permittees and retailers, including mixed beverage
5858 permittees and daily temporary mixed beverage permittees; and
5959 (4) sell ale and malt liquor to a holder of a private
6060 club registration permit.
6161 SECTION 4. This Act takes effect September 1, 2009.
