5	5	relating to the sale of certain alcoholic beverages to private club
6	6	registration permit holders.
7	7	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	8	SECTION 1. Section 19.01, Alcoholic Beverage Code, is
9	9	amended to read as follows:
10	10	Sec. 19.01. AUTHORIZED ACTIVITIES. The holder of a
11	11	wholesaler's permit may:
12	12	(1) purchase and import liquor from distillers,
13	13	brewers, wineries, wine bottlers, rectifiers, and manufacturers
14	14	who are holders of nonresident seller's permits or from their
15	15	agents who hold manufacturer's agents permits;
16	16	(2) purchase liquor from other wholesalers in the
17	17	state;
18	18	(3) sell liquor in the original containers in which it
19	19	is received to retailers and wholesalers in this state authorized
20	20	to sell the liquor; [and]
21	21	(4) sell liquor to qualified persons outside the
22	22	state; and
23	23	(5) sell ale and malt liquor to a holder of a private
24	24	club registration permit.
25	25	SECTION 2. Section 20.01, Alcoholic Beverage Code, is
26	26	amended to read as follows:
27	27	Sec. 20.01. AUTHORIZED ACTIVITIES. The holder of a general
28	28	class B wholesaler's permit may:
29	29	(1) purchase and import malt and vinous liquors from
30	30	brewers, wineries, rectifiers, and wine manufacturers and wine
31	31	bottlers who are the holders of nonresident seller's permits or
32	32	their agents who are holders of manufacturer's agent permits;
33	33	(2) purchase malt and vinous liquors from holders of
34	34	brewer's permits or other wholesalers in the state;
35	35	(3) sell the malt and vinous liquors in the original
36	36	containers in which they are received to retailers and wholesalers
37	37	authorized to sell them in this state, including holders of local
38	38	distributor's permits, mixed beverage permits, and daily temporary
39	39	mixed beverage permits; [and]
40	40	(4) sell the malt and vinous liquors to qualified
41	41	persons outside the state; and
42	42	(5) sell ale and malt liquor to a holder of a private
43	43	club registration permit.
44	44	SECTION 3. Section 21.01, Alcoholic Beverage Code, is
45	45	amended to read as follows:
46	46	Sec. 21.01. AUTHORIZED ACTIVITIES. The holder of a local
47	47	class B wholesaler's permit may:
48	48	(1) purchase and import malt and vinous liquors from
49	49	brewers, wineries, rectifiers, and wine manufacturers and bottlers
50	50	who are holders of nonresident seller's permits and from their
51	51	agents who are holders of manufacturer's agent permits;
52	52	(2) purchase malt and vinous liquors from holders of
53	53	brewer's permits and from other wholesalers in the state; [and]
54	54	(3) sell the malt and vinous liquors, in the original
55	55	containers in which he receives them, to general and local class B
56	56	wholesaler's permittees and, in his county of residence, to local
57	57	distributor's permittees and retailers, including mixed beverage
58	58	permittees and daily temporary mixed beverage permittees; and
59	59	(4) sell ale and malt liquor to a holder of a private
60	60	club registration permit.
61	61	SECTION 4. This Act takes effect September 1, 2009.
