55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the waiting period for eligibility for benefits under
88 the Texas Employees Group Benefits Act.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 1551.1055, Insurance Code, is amended by
1111 amending Subsection (a) and adding Subsection (e) to read as
1212 follows:
1313 (a) Except as provided by this section [Subsection (c) or
1414 (d)], eligibility under Section 1551.101 begins on the first day of
1515 the calendar month that begins after the 90th day after the date the
1616 employee performs services for a state agency or is qualified for
1717 and begins to hold elected or appointed office.
1818 (e) An employee who, at the time the employee is employed by
1919 a state agency, has at least 90 days of state service credit is
2020 eligible under Section 1551.101 on the first day on which the
2121 employee returns to state service.
2222 SECTION 2. The change in law made by this Act applies only
2323 to an employee who returns to state service on or after the
2424 effective date of this Act. An employee who returns to state
2525 service before the effective date of this Act is governed by the law
2626 in effect immediately before that date, and that law is continued in
2727 effect for that purpose.
2828 SECTION 3. This Act takes effect immediately if it receives
2929 a vote of two-thirds of all the members elected to each house, as
3030 provided by Section 39, Article III, Texas Constitution. If this
3131 Act does not receive the vote necessary for immediate effect, this
3232 Act takes effect September 1, 2009.
