| 7 | 7 | | relating to the waiting period for eligibility for benefits under |

| 8 | 8 | | the Texas Employees Group Benefits Act. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 1551.1055, Insurance Code, is amended by |
|---|
| 11 | 11 | | amending Subsection (a) and adding Subsection (e) to read as |
|---|
| 12 | 12 | | follows: |
|---|
| 13 | 13 | | (a) Except as provided by this section [Subsection (c) or |
|---|
| 14 | 14 | | (d)], eligibility under Section 1551.101 begins on the first day of |
|---|
| 15 | 15 | | the calendar month that begins after the 90th day after the date the |
|---|
| 16 | 16 | | employee performs services for a state agency or is qualified for |
|---|
| 17 | 17 | | and begins to hold elected or appointed office. |
|---|
| 18 | 18 | | (e) An employee who, at the time the employee is employed by |
|---|
| 19 | 19 | | a state agency, has at least 90 days of state service credit is |
|---|
| 20 | 20 | | eligible under Section 1551.101 on the first day on which the |
|---|
| 21 | 21 | | employee returns to state service. |
|---|
| 22 | 22 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 23 | 23 | | to an employee who returns to state service on or after the |
|---|
| 24 | 24 | | effective date of this Act. An employee who returns to state |
|---|
| 25 | 25 | | service before the effective date of this Act is governed by the law |
|---|
| 26 | 26 | | in effect immediately before that date, and that law is continued in |
|---|
| 27 | 27 | | effect for that purpose. |
|---|
| 28 | 28 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 29 | 29 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 30 | 30 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 31 | 31 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 32 | 32 | | Act takes effect September 1, 2009. |
