| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 681.003(c), Transportation Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (c) Subject to Subsection (e), the first application must be |
|---|
| 13 | 13 | | accompanied by a notarized written statement or written |
|---|
| 14 | 14 | | prescription of a physician licensed to practice medicine in this |
|---|
| 15 | 15 | | state or a state adjacent to this state[,] or authorized by |
|---|
| 16 | 16 | | applicable law to practice medicine in a hospital or other health |
|---|
| 17 | 17 | | facility of the Veterans Administration or a person acting under |
|---|
| 18 | 18 | | the delegation and supervision of a licensed physician in |
|---|
| 19 | 19 | | conformance with Subchapter B, Chapter 157, Occupations Code, |
|---|
| 20 | 20 | | certifying and providing evidence acceptable to the department that |
|---|
| 21 | 21 | | the person making the application or on whose behalf the |
|---|
| 22 | 22 | | application is made is legally blind or has a mobility problem that |
|---|
| 23 | 23 | | substantially impairs the person's ability to ambulate. The |
|---|
| 24 | 24 | | statement or prescription must include a certification of whether |
|---|
| 25 | 25 | | the disability is temporary or permanent and information acceptable |
|---|
| 26 | 26 | | to the department to determine the type of disabled parking placard |
|---|
| 27 | 27 | | for which the applicant is eligible. The department shall |
|---|
| 28 | 28 | | determine a person's eligibility based on evidence provided by the |
|---|
| 29 | 29 | | applicant establishing legal blindness or mobility impairment. |
|---|
| 30 | 30 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 31 | 31 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 32 | 32 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 33 | 33 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 34 | 34 | | Act takes effect September 1, 2009. |
