66 AN ACT
77 relating to certification of a person as eligible for disabled
88 parking privileges.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 681.003(c), Transportation Code, is
1111 amended to read as follows:
1212 (c) Subject to Subsection (e), the first application must be
1313 accompanied by a notarized written statement or written
1414 prescription of a physician licensed to practice medicine in this
1515 state or a state adjacent to this state[,] or authorized by
1616 applicable law to practice medicine in a hospital or other health
1717 facility of the Veterans Administration or a person acting under
1818 the delegation and supervision of a licensed physician in
1919 conformance with Subchapter B, Chapter 157, Occupations Code,
2020 certifying and providing evidence acceptable to the department that
2121 the person making the application or on whose behalf the
2222 application is made is legally blind or has a mobility problem that
2323 substantially impairs the person's ability to ambulate. The
2424 statement or prescription must include a certification of whether
2525 the disability is temporary or permanent and information acceptable
2626 to the department to determine the type of disabled parking placard
2727 for which the applicant is eligible. The department shall
2828 determine a person's eligibility based on evidence provided by the
2929 applicant establishing legal blindness or mobility impairment.
3030 SECTION 2. This Act takes effect immediately if it receives
3131 a vote of two-thirds of all the members elected to each house, as
3232 provided by Section 39, Article III, Texas Constitution. If this
3333 Act does not receive the vote necessary for immediate effect, this
3434 Act takes effect September 1, 2009.
