55 relating to the appraisal for ad valorem tax purposes of land used
66 for wildlife management.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Subdivision (7), Section 23.51, Tax Code, is
99 amended to read as follows:
1010 (7) "Wildlife management" means:
1111 (A) actively using land that at the time the
1212 wildlife-management use began was appraised as qualified
1313 open-space land under this subchapter or as qualified timber land
1414 under Subchapter E in at least three of the following ways to
1515 propagate a sustaining breeding, migrating, or wintering
1616 population of indigenous wild animals for human use, including
1717 food, medicine, or recreation:
1818 (i) habitat control;
1919 (ii) erosion control;
2020 (iii) predator control;
2121 (iv) providing supplemental supplies of
2222 water;
2323 (v) providing supplemental supplies of
2424 food;
2525 (vi) providing shelters; and
2626 (vii) making of census counts to determine
2727 population;
2828 (B) actively using land to protect federally
2929 listed endangered species under a federal permit if the land is:
3030 (i) included in a habitat preserve and is
3131 subject to a conservation easement created under Chapter 183,
3232 Natural Resources Code; or
3333 (ii) part of a conservation development
3434 under a federally approved habitat conservation plan that restricts
3535 the use of the land to protect federally listed endangered species;
3636 or
3737 (C) actively using land for a conservation or
3838 restoration project to provide compensation for natural resource
3939 damages pursuant to the Comprehensive Environmental Response,
4040 Compensation, and Liability Act of 1980 (42 U.S.C. Section 9601 et
4141 seq.), the Oil Pollution Act of 1990 (33 U.S.C. Section 2701 et
4242 seq.), the Federal Water Pollution Control Act (33 U.S.C. Section
4343 1251 et seq.), or Chapter 40, Natural Resources Code.
4444 SECTION 2. Section 23.52, Tax Code, is amended by adding
4545 Subsection (g) to read as follows:
4646 (g) The category of land that qualifies under Section
4747 23.51(7) is the category of the land under this subchapter or
4848 Subchapter E, as applicable, before the wildlife-management use
4949 began.
5050 SECTION 3. Section 23.56, Tax Code, is amended to read as
5151 follows:
5252 Sec. 23.56. LAND INELIGIBLE FOR APPRAISAL AS OPEN-SPACE
5353 LAND. Land is not eligible for appraisal as provided by this
5454 subchapter if:
5555 (1) the land is located inside the corporate limits of
5656 an incorporated city or town, unless:
5757 (A) the city or town is not providing the land
5858 with governmental and proprietary services substantially
5959 equivalent in standard and scope to those services it provides in
6060 other parts of the city or town with similar topography, land
6161 utilization, and population density; [or]
6262 (B) the land has been devoted principally to
6363 agricultural use continuously for the preceding five years; or
6464 (C) the land:
6565 (i) has been devoted principally to
6666 agricultural use or to production of timber or forest products
6767 continuously for the preceding five years; and
6868 (ii) is used for wildlife management;
6969 (2) the land is owned by an individual who is a
7070 nonresident alien or by a foreign government if that individual or
7171 government is required by federal law or by rule adopted pursuant to
7272 federal law to register his ownership or acquisition of that
7373 property; or
7474 (3) the land is owned by a corporation, partnership,
7575 trust, or other legal entity if the entity is required by federal
7676 law or by rule adopted pursuant to federal law to register its
7777 ownership or acquisition of that land and a nonresident alien or a
7878 foreign government or any combination of nonresident aliens and
7979 foreign governments own a majority interest in the entity.
8080 SECTION 4. This Act takes effect January 1, 2010.
