| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 52.057, Government Code, is amended by |
|---|
| 9 | 9 | | adding Subsection (f) to read as follows: |
|---|
| 10 | 10 | | (f) In lieu of the reimbursements authorized by Section |
|---|
| 11 | 11 | | 52.055, the official court reporters for the 506th Judicial |
|---|
| 12 | 12 | | District shall receive reimbursement for actual and necessary |
|---|
| 13 | 13 | | expenses, including travel expenses, in an amount equal to the |
|---|
| 14 | 14 | | amount of reimbursement that would be provided to a public servant |
|---|
| 15 | 15 | | of the county in which the court is sitting at the time the court |
|---|
| 16 | 16 | | reporter incurs the expenses if the public servant had incurred the |
|---|
| 17 | 17 | | expenses. Each county in the district shall pay a portion of the |
|---|
| 18 | 18 | | reimbursement authorized by this subsection in the proportion that |
|---|
| 19 | 19 | | the county's population bears to the total population of the |
|---|
| 20 | 20 | | district. For purposes of this subsection, "public servant" |
|---|
| 21 | 21 | | includes an officer, employee, or agent of a county. |
|---|
| 22 | 22 | | SECTION 2. The change in law made by this Act applies to |
|---|
| 23 | 23 | | expenses incurred by a court reporter on or after the effective date |
|---|
| 24 | 24 | | of this Act. Expenses incurred by a court reporter before the |
|---|
| 25 | 25 | | effective date of this Act are governed by the law in effect on the |
|---|
| 26 | 26 | | date the expenses were incurred, and the former law is continued in |
|---|
| 27 | 27 | | effect for that purpose. |

| 28 | 28 | | SECTION 3. This Act takes effect September 1, 2009. |
