| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 12, Chapter 1359 (H.B. 3651), Acts of the |
|---|
| 11 | 11 | | 77th Legislature, Regular Session, 2001, is amended to read as |
|---|
| 12 | 12 | | follows: |
|---|
| 13 | 13 | | Sec. 12. ELECTION OF REGULAR DIRECTORS. Beginning in the |
|---|
| 14 | 14 | | second year following the confirmation election under Section 8 of |
|---|
| 15 | 15 | | this Act, an election shall be held on the first uniform election |
|---|
| 16 | 16 | | date in November [May] every two years to elect the appropriate |
|---|
| 17 | 17 | | number of directors to the board. At the first election, directors |
|---|
| 18 | 18 | | for Places 2, 4, and 6 shall be elected. At the next election, |
|---|
| 19 | 19 | | directors for Places 1, 3, 5, and 7 shall be elected. |
|---|
| 20 | 20 | | SECTION 2. (a) All governmental and proprietary actions of |
|---|
| 21 | 21 | | the Goliad County Groundwater Conservation District taken before |
|---|
| 22 | 22 | | the effective date of this Act are validated, ratified, and |
|---|
| 23 | 23 | | confirmed in all respects as if the actions had been taken as |
|---|
| 24 | 24 | | authorized by law. |
|---|
| 25 | 25 | | (b) This section does not apply to any matter that on the |
|---|
| 26 | 26 | | effective date of this Act: |
|---|
| 27 | 27 | | (1) is involved in litigation if the litigation |
|---|
| 28 | 28 | | ultimately results in the matter being held invalid by a final court |
|---|
| 29 | 29 | | judgment; or |
|---|
| 30 | 30 | | (2) has been held invalid by a final court judgment. |
|---|
| 31 | 31 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 32 | 32 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 33 | 33 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 34 | 34 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 35 | 35 | | Act takes effect September 1, 2009. |
