| 10 | 10 | SECTION 1. Chapter 71, Penal Code, is amended by adding | |
| 11 | 11 | Section 71.023 to read as follows: | |
| 12 | 12 | Sec. 71.023. DIRECTING ACTIVITIES OF A CRIMINAL STREET | |
| 13 | 13 | GANG. (a) A person commits an offense if the person knowingly | |
| 14 | 14 | initiates, organizes, plans, finances, directs, manages, or | |
| 15 | 15 | supervises a criminal street gang or members of a criminal street | |
| 16 | 16 | gang with the intent to benefit, to promote, or to further the | |
| 17 | 17 | interests of the criminal street gang or to increase the person's | |
| 18 | 18 | standing, position, or status in the criminal street gang. | |
| 19 | 19 | (b) An offense under this section is a felony of the first | |
| 20 | 20 | degree. | |
| 21 | 21 | SECTION 2. This Act takes effect September 1, 2009. |
