66 AN ACT
77 relating to free breakfast for certain public school students.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 33.901, Education Code, is amended to
1010 read as follows:
1111 Sec. 33.901. BREAKFAST PROGRAMS. (a) If at least 10
1212 percent of the students enrolled in one or more schools in a school
1313 district or enrolled in an open-enrollment charter school are
1414 eligible for free or reduced-price breakfasts under the national
1515 school breakfast program provided for by the Child Nutrition Act of
1616 1966 (42 U.S.C. Section 1773), the governing body of the district or
1717 the open-enrollment charter school shall participate in the program
1818 and make the benefits of the program available to all eligible
1919 students in the schools or school.
2020 (b) A school district campus or an open-enrollment charter
2121 school participating in the national school breakfast program
2222 provided by the Child Nutrition Act of 1966 (42 U.S.C. Section 1773)
2323 in which 60 percent or more of the students qualify for a free or
2424 reduced-price breakfast shall provide a free breakfast to an
2525 elementary school student during school hours. The Department of
2626 Agriculture shall reimburse the school district or open-enrollment
2727 charter school for any lost revenue resulting from a free breakfast
2828 provided under this subsection.
2929 (c) The Department of Agriculture may adopt rules necessary
3030 to implement this section.
3131 SECTION 2. This Act applies beginning with the 2009-2010
3232 school year.
3333 SECTION 3. This Act takes effect September 1, 2009.
