8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Section 33.901, Education Code, is amended to |
---|
10 | 10 | | read as follows: |
---|
11 | 11 | | Sec. 33.901. BREAKFAST PROGRAMS. (a) If at least 10 |
---|
12 | 12 | | percent of the students enrolled in one or more schools in a school |
---|
13 | 13 | | district or enrolled in an open-enrollment charter school are |
---|
14 | 14 | | eligible for free or reduced-price breakfasts under the national |
---|
15 | 15 | | school breakfast program provided for by the Child Nutrition Act of |
---|
16 | 16 | | 1966 (42 U.S.C. Section 1773), the governing body of the district or |
---|
17 | 17 | | the open-enrollment charter school shall participate in the program |
---|
18 | 18 | | and make the benefits of the program available to all eligible |
---|
19 | 19 | | students in the schools or school. |
---|
20 | 20 | | (b) A school district campus or an open-enrollment charter |
---|
21 | 21 | | school participating in the national school breakfast program |
---|
22 | 22 | | provided by the Child Nutrition Act of 1966 (42 U.S.C. Section 1773) |
---|
23 | 23 | | in which 60 percent or more of the students qualify for a free or |
---|
24 | 24 | | reduced-price breakfast shall provide a free breakfast to an |
---|
25 | 25 | | elementary school student during school hours. The Department of |
---|
26 | 26 | | Agriculture shall reimburse the school district or open-enrollment |
---|
27 | 27 | | charter school for any lost revenue resulting from a free breakfast |
---|
28 | 28 | | provided under this subsection. |
---|
29 | 29 | | (c) The Department of Agriculture may adopt rules necessary |
---|
30 | 30 | | to implement this section. |
---|
31 | 31 | | SECTION 2. This Act applies beginning with the 2009-2010 |
---|
32 | 32 | | school year. |
---|
33 | 33 | | SECTION 3. This Act takes effect September 1, 2009. |
