99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter F, Chapter 4055, Insurance Code, is
1111 amended to read as follows:
1212 SUBCHAPTER F. PORTABLE ELECTRONIC [TELECOMMUNICATIONS EQUIPMENT]
1313 VENDOR LICENSE
1414 Sec. 4055.251. DEFINITIONS. In this subchapter:
1515 (1) "Customer" means a person who purchases a portable
1616 electronic device or a related service [telecommunications
1717 equipment in a retail sales transaction].
1818 (2) "Portable electronic devices" includes
1919 ["Telecommunications equipment" includes] handsets, pagers,
2020 personal digital assistants, portable global positioning system
2121 units, portable computers, portable audio listening devices,
2222 gaming systems, cameras, automatic answering devices, batteries,
2323 and other similar electronic devices and their accessories [used to
2424 originate or receive wireless communications exclusive of
2525 cordless, wireline communications].
2626 (3) "Vendor" means a person or entity engaged in the
2727 business of leasing, selling, or providing portable electronic
2828 devices or related services to customers.
2929 Sec. 4055.252. ISSUANCE OF LICENSE; LICENSE FEE. (a)
3030 Notwithstanding any other provision of this chapter or this code,
3131 the commissioner may issue a specialty license to a [retail] vendor
3232 [of telecommunications equipment] who complies with this
3333 subchapter. The specialty license may be issued only for the
3434 limited purposes specified by this subchapter.
3535 (b) A specialty license issued to a vendor under this
3636 subchapter authorizes the vendor and any employee or authorized
3737 representative of the vendor to offer the type of coverage
3838 specified in this subchapter at each location at which the vendor
3939 engages in business.
4040 (c) The commissioner shall impose an annual license fee for
4141 a specialty license issued under this subchapter. The commissioner
4242 shall set the license fee in an amount reasonable and necessary to
4343 cover the costs of administering this subchapter, not to exceed
4444 $5,000.
4545 Sec. 4055.253. AUTHORITY OF [RETAIL] VENDOR OF PORTABLE
4646 ELECTRONIC DEVICES [TELECOMMUNICATIONS EQUIPMENT]. A [retail]
4747 vendor [of telecommunications equipment] licensed under this
4848 subchapter and the vendor's employee and authorized representative
4949 [chapter] may act as an agent for an authorized insurer [only:
5050 [(1)] in connection with the sale and use of portable
5151 electronic devices and related services only [telecommunications
5252 equipment; and
5353 [(2)] with respect to:
5454 (1) [(A)] insurance coverage provided to customers
5555 that covers portable electronic devices against one or more of the
5656 following:
5757 (A) loss;
5858 (B) theft;
5959 (C) mechanical failure;
6060 (D) malfunction;
6161 (E) damage; or
6262 (F) other applicable perils [for the loss or
6363 malfunction of or damage to telecommunications equipment]; or
6464 (2) the provision of [(B)] any other coverage the
6565 commissioner approves as meaningful and appropriate in connection
6666 with the use of portable electronic devices or related services
6767 [telecommunications equipment].
6868 Sec. 4055.254. INSURANCE POLICY; REQUIREMENTS. (a)
6969 Insurance provided under this subchapter must be issued to a
7070 licensed vendor under a master or group policy of commercial inland
7171 marine insurance. A customer may be designated as an additional
7272 insured or certificate holder under the policy.
7373 (b) A licensed vendor shall provide to each customer
7474 designated as an additional insured or certificate holder a
7575 coverage form, certificate, or other evidence of coverage in a
7676 brochure or separate document.
7777 Sec. 4055.255. REQUIRED TRAINING. (a) Notwithstanding
7878 Section 4055.012, an agent who holds a license issued under Chapter
7979 4051 or a substantially equivalent license issued under this code
8080 and who is appointed by the insurer that insures a vendor may:
8181 (1) provide the materials for the training program
8282 required under Section 4055.012; and
8383 (2) conduct the applicable training.
8484 (b) An agent described by Subsection (a) shall submit the
8585 training program materials for approval as required under Section
8686 4055.012(c).
8787 SECTION 2. The commissioner of insurance shall, by rule,
8888 establish a procedure under which a person holding a license as a
8989 telecommunications equipment vendor specialty agent that was
9090 issued under Subchapter F, Chapter 4055, Insurance Code, as it
9191 existed before amendment by this Act, may convert that license to a
9292 portable electronic device vendor specialty agent license under
9393 Subchapter F, Chapter 4055, Insurance Code, as amended by this Act,
9494 without further qualification. The rules may establish a reasonable
9595 period for the agent to comply with Section 4055.254, Insurance
9696 Code, as added by this Act.
9797 SECTION 3. This Act takes effect September 1, 2009.
