| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Chapter 234, Local Government Code, is amended |
|---|
| 10 | 10 | | by adding Subchapter C to read as follows: |

| 11 | 11 | | SUBCHAPTER C. COUNTY INSPECTION OF DAY-CARE CENTERS AND GROUP |
|---|
| 12 | 12 | | DAY-CARE HOMES LOCATED IN MUNICIPALITIES |
|---|
| 13 | 13 | | Sec. 234.051. DEFINITIONS. In this subchapter: |

| 14 | 14 | | (1) "Day-care center" has the meaning assigned by |
|---|
| 15 | 15 | | Section 42.002, Human Resources Code. |
|---|
| 16 | 16 | | (2) "Group day-care home" has the meaning assigned by |
|---|
| 17 | 17 | | Section 42.002, Human Resources Code. |
|---|
| 18 | 18 | | Sec. 234.052. APPLICABILITY. This subchapter applies only |
|---|
| 19 | 19 | | to a county with a population of 700,000 or more. |
|---|
| 20 | 20 | | Sec. 234.053. FACILITY INSPECTION REQUIRED BY |
|---|
| 21 | 21 | | MUNICIPALITY. A county health officer or official designated by |
|---|
| 22 | 22 | | the commissioners court may contract with a municipality for the |
|---|
| 23 | 23 | | county to conduct an inspection required by the municipality of a |
|---|
| 24 | 24 | | day-care center or group day-care home located in the municipality. |
|---|
| 25 | 25 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 26 | 26 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 27 | 27 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 28 | 28 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 29 | 29 | | Act takes effect September 1, 2009. |
