| 7 | 7 | | relating to the date on which eligibility for benefits begins under |

| 8 | 8 | | certain programs for governmental employees and retirees. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Sections 1551.1055(a) and (b), Insurance Code, |
|---|
| 11 | 11 | | are amended to read as follows: |
|---|
| 12 | 12 | | (a) Except as provided by Subsection (c) or (d), eligibility |
|---|
| 13 | 13 | | under Section 1551.101 begins on the first day of the calendar month |
|---|
| 14 | 14 | | that begins after the 45th [90th] day after the date the employee |
|---|
| 15 | 15 | | performs services for a state agency or is qualified for and begins |
|---|
| 16 | 16 | | to hold elected or appointed office. |
|---|
| 17 | 17 | | (b) Except as provided by Subsection (c), eligibility under |
|---|
| 18 | 18 | | Section 1551.102, for an individual who does not retire at the end |
|---|
| 19 | 19 | | of the last month for which the individual is on the payroll of a |
|---|
| 20 | 20 | | state agency before retirement, begins on the first day of the |
|---|
| 21 | 21 | | calendar month that begins after the 45th [90th] day after the date |
|---|
| 22 | 22 | | the individual retires. |

| 23 | 23 | | SECTION 2. Sections 1601.1045(a) and (b), Insurance Code, |
|---|
| 24 | 24 | | are amended to read as follows: |
|---|
| 25 | 25 | | (a) Except as provided by Subsection (c) or (d), eligibility |
|---|
| 26 | 26 | | under Section 1601.101 begins on the first day of the calendar month |
|---|
| 27 | 27 | | that begins after the 45th [90th] day after the date the employee |
|---|
| 28 | 28 | | performs services for a system. |
|---|
| 29 | 29 | | (b) Except as provided by Subsection (c), eligibility under |
|---|
| 30 | 30 | | Section 1601.102, for an individual who does not retire at the end |
|---|
| 31 | 31 | | of the last month for which the individual is on the payroll of a |
|---|
| 32 | 32 | | system before retirement, begins on the first day of the calendar |
|---|

| 35 | 35 | | SECTION 3. A waiting period that, immediately before the |
|---|
| 36 | 36 | | effective date of this Act, is applicable to an individual under |
|---|
| 37 | 37 | | Section 1551.1055 or 1601.1045, Insurance Code, as those sections |
|---|
| 38 | 38 | | existed before amendment by this Act, terminates on the effective |
|---|
| 39 | 39 | | date of this Act. |
|---|
| 40 | 40 | | SECTION 4. This Act takes effect September 1, 2009. |
