| 8 | 8 | | hold an election of trustees. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 11.0581(a), Education Code, is amended |
|---|
| 11 | 11 | | to read as follows: |
|---|
| 12 | 12 | | (a) An election for trustees of an independent school |
|---|
| 13 | 13 | | district shall be held on the same date as: |
|---|
| 14 | 14 | | (1) the election for the members of the governing body |
|---|
| 15 | 15 | | of a municipality located in the school district; or |
|---|
| 16 | 16 | | (2) the general election for state and county |
|---|
| 17 | 17 | | officers[; or |
|---|
| 18 | 18 | | [(3) the election for the members of the governing |
|---|
| 19 | 19 | | body of a hospital district, if the school district: |
|---|
| 20 | 20 | | [(A) is wholly or partly located in a county with |
|---|
| 21 | 21 | | a population of less than 30,000 that is adjacent to a county with a |
|---|
| 22 | 22 | | population of more than three million; and |
|---|
| 23 | 23 | | [(B) held its election for trustees jointly with |
|---|
| 24 | 24 | | the election for the members of the governing body of the hospital |
|---|
| 25 | 25 | | district before May 2007]. |

| 26 | 26 | | SECTION 2. Not later than December 31, 2009, the board of |
|---|
| 27 | 27 | | trustees of an independent school district that holds its general |
|---|
| 28 | 28 | | election for trustees on the same date as the election for members |
|---|
| 29 | 29 | | of the governing body of a hospital district under Section |
|---|
| 30 | 30 | | 11.0581(a)(3), Education Code, as that section existed before the |
|---|
| 31 | 31 | | effective date of this Act, must: |
|---|
| 32 | 32 | | (1) change the date on which the school district holds |
|---|
| 33 | 33 | | its general election for trustees to allow the district to hold its |
|---|
| 34 | 34 | | election on the same date as the election for members of the |
|---|
| 35 | 35 | | governing body of a municipality located in the school district or |
|---|
| 36 | 36 | | on the same date as the general election for state and county |
|---|
| 37 | 37 | | officers as provided by Section 11.0581, Education Code, as amended |
|---|
| 38 | 38 | | by this Act; and |
|---|
| 39 | 39 | | (2) adjust the terms of office of school district |
|---|
| 40 | 40 | | trustees as necessary to conform to the change of the election date |
|---|
| 41 | 41 | | made under Subdivision (1) of this section. |
|---|
| 42 | 42 | | SECTION 3. This Act takes effect September 1, 2009. |
