77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 123.005, Property Code, is amended to
99 read as follows:
1010 Sec. 123.005. BREACH OF FIDUCIARY DUTY: VENUE.
1111 [(a)] Venue in a proceeding brought by the attorney general
1212 alleging breach of a fiduciary duty by a charitable entity or a
1313 fiduciary or managerial agent of a charitable trust shall be a court
1414 of competent jurisdiction in Travis County or in the county where
1515 the defendant resides or has its principal office.
1616 [(b) The attorney general, if successful in the proceeding,
1717 is entitled to recover from a fiduciary or managerial agent of a
1818 charitable trust actual costs incurred in bringing the suit and may
1919 recover reasonable attorney's fees.]
2020 SECTION 2. Chapter 123, Property Code, is amended by adding
2121 Section 123.006 to read as follows:
2222 Sec. 123.006. ATTORNEY'S FEES. (a) In a proceeding
2323 subject to Section 123.005, the attorney general, if successful in
2424 the proceeding, is entitled to recover from the charitable entity
2525 or fiduciary or managerial agent of the charitable trust actual
2626 costs incurred in bringing the suit and may recover reasonable
2727 attorney's fees.
2828 (b) In a proceeding in which the attorney general intervenes
2929 under this chapter, other than a proceeding subject to Section
3030 123.005, a court may award the attorney general court costs and
3131 reasonable and necessary attorney's fees as may seem equitable and
3232 just.
3333 SECTION 3. The change in law made by this Act applies only
3434 to a proceeding commenced on or after the effective date of this
3535 Act. A proceeding commenced before the effective date of this Act
3636 is governed by the law in effect immediately before that date, and
3737 that law is continued in effect for that purpose.
3838 SECTION 4. This Act takes effect September 1, 2009.
