| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Chapter 43, Parks and Wildlife Code, is amended |
|---|
| 11 | 11 | | by adding Subchapter A to read as follows: |

| 12 | 12 | | SUBCHAPTER A. GENERAL PROVISIONS |

| 13 | 13 | | [Sec. 43.001. Reserved] |
|---|
| 14 | 14 | | Sec. 43.002. NOTICE OF PROPOSED PERMIT FEE INCREASE. (a) |
|---|
| 15 | 15 | | Except as provided by Subsections (b) and (c), the department shall |
|---|
| 16 | 16 | | provide written notice to a person who holds a permit issued by the |
|---|
| 17 | 17 | | department under this chapter at least 90 days before the date on |
|---|
| 18 | 18 | | which the amount of the fee for that type of permit is proposed to |
|---|
| 19 | 19 | | increase. |
|---|
| 20 | 20 | | (b) The department is required to provide notice under |
|---|
| 21 | 21 | | Subsection (a) only if the proposed permit fee amount is at least |
|---|
| 22 | 22 | | three times the amount of the fee in effect for a permit of that |
|---|
| 23 | 23 | | type. |
|---|
| 24 | 24 | | (c) The notice requirement under this section does not apply |
|---|
| 25 | 25 | | to a proposed fee increase for a license or other authorization |
|---|
| 26 | 26 | | issued by the department under this chapter. |
|---|
| 27 | 27 | | SECTION 2. Section 43.002, Parks and Wildlife Code, as |
|---|
| 28 | 28 | | added by this Act, applies only to an increase in the fee for a |
|---|
| 29 | 29 | | permit as provided by that section that is proposed to take effect |
|---|
| 30 | 30 | | on or after September 1, 2009. An increase in the fee for a permit |
|---|
| 31 | 31 | | that is proposed to take effect before September 1, 2009, is |
|---|
| 32 | 32 | | governed by the law in effect immediately before September 1, 2009, |
|---|
| 33 | 33 | | and that law continues in effect for that purpose. |
|---|
| 34 | 34 | | SECTION 3. This Act takes effect September 1, 2009. |
