88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subtitle F, Title 6, Special District Local Laws
1010 Code, is amended by adding Chapter 8323 to read as follows:
1111 CHAPTER 8323. SIENNA PLANTATION MUNICIPAL UTILITY DISTRICT NO. 7
1212 SUBCHAPTER A. GENERAL PROVISIONS
1313 Sec. 8323.001. DEFINITION. In this chapter, "district"
1414 means the Sienna Plantation Municipal Utility District No. 7.
1515 Sec. 8323.002. NATURE AND PURPOSES OF DISTRICT. (a) The
1616 district is a municipal utility district created under and
1717 essential to accomplish the purposes of Section 59, Article XVI,
1818 Texas Constitution.
1919 (b) The district is essential to accomplish the purposes of
2020 Section 52, Article III, Texas Constitution, that relate to the
2121 construction, acquisition, improvement, operation, or maintenance
2222 of macadamized, graveled, or paved roads, or improvements,
2323 including storm drainage, in aid of those roads.

2525 SUBCHAPTER B. POWERS AND DUTIES
2626 Sec. 8323.051. GENERAL POWERS AND DUTIES. The district has
2727 the powers and duties necessary to accomplish the purposes
2828 described by Section 8323.002.
2929 Sec. 8323.052. MUNICIPAL UTILITY DISTRICT POWERS AND
3030 DUTIES. The district has the powers and duties provided by the
3131 general law of this state, including Chapters 49 and 54, Water Code,
3232 applicable to municipal utility districts created under Section 59,
3333 Article XVI, Texas Constitution.
3434 Sec. 8323.053. AUTHORITY FOR ROAD PROJECTS. Under Section
3535 52, Article III, Texas Constitution, the district may design,
3636 acquire, construct, finance, issue bonds for, improve, operate,
3737 maintain, and convey to this state, a county, or a municipality for
3838 operation and maintenance macadamized, graveled, or paved roads, or
3939 improvements, including storm drainage, in aid of those roads.
4040 Sec. 8323.054. ROAD STANDARDS AND REQUIREMENTS. (a) A
4141 road project must meet all applicable construction standards,
4242 zoning and subdivision requirements, and regulations of each
4343 municipality in whose corporate limits or extraterritorial
4444 jurisdiction the road project is located.
4545 (b) If a road project is not located in the corporate limits
4646 or extraterritorial jurisdiction of a municipality, the road
4747 project must meet all applicable construction standards,
4848 subdivision requirements, and regulations of each county in which
4949 the road project is located.
5050 (c) If the state will maintain and operate the road, the
5151 Texas Transportation Commission must approve the plans and
5252 specifications of the road project.
5353 Sec. 8323.055. LIMITATION ON USE OF EMINENT DOMAIN. The
5454 district may not exercise the power of eminent domain outside the
5555 district to acquire a site or easement for a road project authorized
5656 by Section 8323.053.

5858 SUBCHAPTER C. BONDS AND OTHER OBLIGATIONS
5959 Sec. 8323.101. AUTHORITY TO ISSUE BONDS AND OTHER
6060 OBLIGATIONS FOR ROAD PROJECTS. (a) The district may issue bonds
6161 or other obligations payable wholly or partly from ad valorem
6262 taxes, impact fees, revenue, contract payments, grants, or other
6363 district money, or any combination of those sources, to pay for a
6464 road project authorized by Section 8323.053.
6565 (b) The district may not issue bonds payable from ad valorem
6666 taxes to finance a road project unless the issuance is approved by a
6767 vote of a two-thirds majority of the district voters voting at an
6868 election held for that purpose.
6969 (c) At the time of issuance, the total principal amount of
7070 bonds or other obligations issued or incurred to finance road
7171 projects and payable from ad valorem taxes may not exceed
7272 one-fourth of the assessed value of the real property in the
7373 district.
7474 Sec. 8323.102. TAXES FOR BONDS. At the time the district
7575 issues bonds payable wholly or partly from ad valorem taxes, the
7676 district shall provide for the annual imposition of a continuing
7777 direct ad valorem tax, without limit as to rate or amount, while all
7878 or part of the bonds are outstanding as required and in the manner
7979 provided by Sections 54.601 and 54.602, Water Code.
8080 SECTION 2. The Sienna Plantation Municipal Utility District
8181 No. 7 retains all the rights, powers, privileges, authority,
8282 duties, and functions that it had before the effective date of this
8383 Act.
8484 SECTION 3. (a) The legal notice of the intention to
8585 introduce this Act, setting forth the general substance of this
8686 Act, has been published as provided by law, and the notice and a
8787 copy of this Act have been furnished to all persons, agencies,
8888 officials, or entities to which they are required to be furnished
8989 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
9090 Government Code.
9191 (b) The governor, one of the required recipients, has
9292 submitted the notice and Act to the Texas Commission on
9393 Environmental Quality.
9494 (c) The Texas Commission on Environmental Quality has filed
9595 its recommendations relating to this Act with the governor, the
9696 lieutenant governor, and the speaker of the house of
9797 representatives within the required time.
9898 (d) All requirements of the constitution and laws of this
9999 state and the rules and procedures of the legislature with respect
100100 to the notice, introduction, and passage of this Act are fulfilled
101101 and accomplished.
102102 SECTION 4. This Act takes effect immediately if it receives
103103 a vote of two-thirds of all the members elected to each house, as
104104 provided by Section 39, Article III, Texas Constitution. If this
105105 Act does not receive the vote necessary for immediate effect, this
106106 Act takes effect September 1, 2009.
