| 5 | 5 | | relating to authorizing a judge of a municipal court to conduct a |

| 6 | 6 | | marriage ceremony. |

| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Subsection (a), Section 2.202, Family Code, is |
|---|
| 9 | 9 | | amended to read as follows: |
|---|
| 10 | 10 | | (a) The following persons are authorized to conduct a |
|---|
| 11 | 11 | | marriage ceremony: |
|---|
| 12 | 12 | | (1) a licensed or ordained Christian minister or |
|---|
| 13 | 13 | | priest; |
|---|
| 14 | 14 | | (2) a Jewish rabbi; |
|---|
| 15 | 15 | | (3) a person who is an officer of a religious |
|---|
| 16 | 16 | | organization and who is authorized by the organization to conduct a |
|---|
| 17 | 17 | | marriage ceremony; and |
|---|
| 18 | 18 | | (4) a justice of the supreme court, judge of the court |
|---|
| 19 | 19 | | of criminal appeals, justice of the courts of appeals, judge of the |
|---|
| 20 | 20 | | district, county, and probate courts, judge of the county courts at |
|---|
| 21 | 21 | | law, judge of the courts of domestic relations, judge of the |
|---|
| 22 | 22 | | juvenile courts, retired justice or judge of those courts, justice |
|---|
| 23 | 23 | | of the peace, retired justice of the peace, judge of a municipal |
|---|
| 24 | 24 | | court, or judge or magistrate of a federal court of this state. |

| 25 | 25 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 26 | 26 | | to a marriage ceremony that is conducted on or after the effective |
|---|
| 27 | 27 | | date of this Act. A marriage ceremony conducted before the |
|---|
| 28 | 28 | | effective date of this Act is governed by the law in effect on the |
|---|
| 29 | 29 | | date the ceremony was conducted, and the former law is continued in |
|---|
| 30 | 30 | | effect for that purpose. |

| 31 | 31 | | SECTION 3. This Act takes effect September 1, 2009. |
