7 | 7 | | relating to eligibility of certain job trainees for extended |
---|
8 | 8 | | unemployment compensation benefits. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
10 | 10 | | SECTION 1. Section 209.041, Labor Code, is amended to read |
---|
11 | 11 | | as follows: |
---|
12 | 12 | | Sec. 209.041. ELIGIBILITY FOR EXTENDED BENEFITS. (a) An |
---|
13 | 13 | | individual is eligible to receive extended benefits for a benefit |
---|
14 | 14 | | period of unemployment in the individual's eligibility period if, |
---|
15 | 15 | | with respect to the benefit period, the individual: |
---|
16 | 16 | | (1) has exhausted all regular benefits; |
---|
17 | 17 | | (2) satisfies the requirements of this subtitle for |
---|
18 | 18 | | the receipt of regular benefits that are applicable to an |
---|
19 | 19 | | individual claiming extended benefits, including not being |
---|
20 | 20 | | disqualified for the receipt of benefits; and |
---|
21 | 21 | | (3) has within the individual's base period received |
---|
22 | 22 | | benefit wage credits for employment by employers in an amount not |
---|
23 | 23 | | less than: |
---|
24 | 24 | | (A) 40 times the individual's weekly benefit |
---|
25 | 25 | | amount; or |
---|
26 | 26 | | (B) 1-1/2 times the individual's high-quarter |
---|
27 | 27 | | benefit wage credits. |
---|
28 | 28 | | (b) Notwithstanding Subsection (a), an individual is also |
---|
29 | 29 | | eligible to receive extended benefits for a benefit period of |
---|
30 | 30 | | unemployment in the individual's eligibility period if, with |
---|
31 | 31 | | respect to the benefit period, the individual: |
---|
32 | 32 | | (1) has exhausted all regular benefits; and |
---|
33 | 33 | | (2) is participating in a training program approved by |
---|
34 | 34 | | the commission under Section 207.022. |
---|
35 | 35 | | SECTION 2. The change in law made by this Act applies only |
---|
36 | 36 | | to a claim for extended unemployment compensation benefits that is |
---|
37 | 37 | | filed with the Texas Workforce Commission on or after the effective |
---|
38 | 38 | | date of this Act. A claim filed before that date is governed by the |
---|
39 | 39 | | law in effect on the date that the claim was filed, and the former |
---|
40 | 40 | | law is continued in effect for that purpose. |
---|
41 | 41 | | SECTION 3. This Act takes effect immediately if it receives |
---|
42 | 42 | | a vote of two-thirds of all the members elected to each house, as |
---|
43 | 43 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
44 | 44 | | Act does not receive the vote necessary for immediate effect, this |
---|
45 | 45 | | Act takes effect September 1, 2009. |
---|
