| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Subsection (a), Section 201.301, Transportation |
|---|
| 9 | 9 | | Code, is amended to read as follows: |
|---|
| 10 | 10 | | (a) The commission shall elect an executive director for the |
|---|
| 11 | 11 | | department. The director must be [a registered professional |
|---|
| 12 | 12 | | engineer in this state and] experienced and skilled in |
|---|
| 13 | 13 | | transportation planning and[,] development[, construction,] and in |
|---|
| 14 | 14 | | organizational management [maintenance]. |
|---|
| 15 | 15 | | SECTION 2. (a) The change in law made by this Act applies |
|---|
| 16 | 16 | | only to a person elected by the Texas Transportation Commission as |
|---|
| 17 | 17 | | the executive director of the Texas Department of Transportation on |
|---|
| 18 | 18 | | or after the effective date of this Act. |
|---|
| 19 | 19 | | (b) The change in law made by this Act does not affect the |
|---|
| 20 | 20 | | right of the person serving as the executive director of the Texas |
|---|
| 21 | 21 | | Department of Transportation on the effective date of this Act to |
|---|
| 22 | 22 | | continue to serve as the executive director of that department. |
|---|
| 23 | 23 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 24 | 24 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 25 | 25 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 26 | 26 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 27 | 27 | | Act takes effect September 1, 2009. |
