44 SENATE CONCURRENT RESOLUTION
55 WHEREAS, The Tenth Amendment to the Constitution of the
66 United States reads as follows: "The powers not delegated to the
77 United States by the Constitution, nor prohibited by it to the
88 States, are reserved to the States respectively, or to the people";
99 and
1010 WHEREAS, The Tenth Amendment defines the total scope of
1111 federal power as being that specifically granted by the
1212 Constitution of the United States and no more; and
1313 WHEREAS, The Tenth Amendment assures that we, the people of
1414 the United States of America and each sovereign state in the Union
1515 of States, now have, and have always had, rights the federal
1616 government may not usurp; and
1717 WHEREAS, Section 4, Article IV, of the Constitution says,
1818 "The United States shall guarantee to every State in this Union a
1919 Republican Form of Government," and the Ninth Amendment states that
2020 "The enumeration in the Constitution, of certain rights, shall not
2121 be construed to deny or disparage others retained by the people";
2222 and
2323 WHEREAS, The United States Supreme Court has ruled in New
2424 York v. United States, 505 U.S. 144 (1992), and Printz v. United
2525 States, 521 U.S. 898 (1997), that Congress may not simply
2626 commandeer the legislative, executive, and regulatory processes of
2727 the states, and that, to do so, is a violation of the Tenth
2828 Amendment; and
2929 WHEREAS, one of our nation's Founders and author of the
3030 Declaration of Independence, Thomas Jefferson, emphasized that the
3131 states are not "subordinate" to the national government, but rather
3232 the two are "coordinate departments of one simple and integral
3333 whole."; and
3434 WHEREAS, one of the authors of the Federalist Papers,
3535 Alexander Hamilton, expressed his hope that "the people will always
3636 take care to preserve the constitutional equilibrium between the
3737 general and the state governments." And, that, "this balance
3838 between the national and state governments forms a double security
3939 to the people."; and
4040 WHEREAS, A number of proposals from previous administrations
4141 and some now pending from the present administration and from
4242 Congress threaten to disturb this delicate balance between the
4343 federal government and the state governments; and
4444 WHEREAS, Such encroachments by the federal government may
4545 result in a commandeering of the states' legislative, executive,
4646 and regulatory processes; and
4747 WHEREAS, These acts undermine the spirit of the federalist
4848 system created by our Founders and are in violation of the Tenth
4949 Amendment to the Constitution of the United States; now, therefore,
5050 be it
5151 RESOLVED, That the 81st Legislature of the State of Texas
5252 hereby claims sovereignty under the Tenth Amendment to the
5353 Constitution of the United States over all powers not otherwise
5454 enumerated and granted to the federal government by the
5555 Constitution of the United States; and, be it further
5656 RESOLVED, That this serve as notice and demand to the federal
5757 government to cease and desist, effective immediately, mandates
5858 that are beyond the scope of these constitutionally delegated
5959 powers; and, be it further
6060 RESOLVED, That the power over the freedom of the right to keep
6161 and bear arms was reserved to the states and therefore, all acts of
6262 Congress to abridge that right are not law and are void; and, be it
6363 further
6464 RESOLVED, That all compulsory federal legislation that
6565 directs states to comply under threat of civil or criminal
6666 penalties or sanctions or that requires states to pass legislation
6767 or lose federal funding be prohibited or repealed; and, be it
6868 further
6969 RESOLVED, That the Texas Secretary of State forward official
7070 copies of this resolution to the President of the United States, to
7171 the Speaker of the House of Representatives and the President of the
7272 Senate of the United States Congress, and to all the members of the
7373 Texas delegation to the Congress with the request that this
7474 resolution be officially entered in the Congressional Record as a
7575 memorial to the Congress of the United States of America.
