4	4	SENATE CONCURRENT RESOLUTION
5	5	WHEREAS, Senate Bill No. 1492 has been adopted by the house of
6	6	representatives and the senate and is being prepared for
7	7	enrollment; and
8	8	WHEREAS, The bill contains technical errors that should be
9	9	corrected; now, therefore, be it
10	10	RESOLVED by the 81st Legislature of the State of Texas, That
11	11	the enrolling clerk of the senate be instructed to correct SECTION 3
12	12	of the bill by striking Subsection (i), Section 39.452, Utilities
13	13	Code, as added by House Committee Amendment No. 1, and substituting
14	14	the following:
15	15	(j) Notwithstanding any other provision of this subtitle,
16	16	in awarding a certificate of convenience and necessity or allowing
17	17	cost recovery for purchased power by an electric utility subject to
18	18	this section, the commission shall ensure in its determination that
19	19	the provisions of Sections 37.056(c)(4)(D) and (E) are met and that
20	20	the generating facility or the purchased power agreement satisfies
21	21	the identified reliability needs of the utility.
