| 10 | 10 | | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Article III, Texas Constitution, is amended by |
|---|
| 12 | 12 | | adding Section 52k to read as follows: |
|---|
| 13 | 13 | | Sec. 52k. (a) The legislature by general law may: |
|---|
| 14 | 14 | | (1) authorize a county to enact: |
|---|
| 15 | 15 | | (A) a local tax on the sale of gasoline and diesel |
|---|
| 16 | 16 | | fuel in the county; and |
|---|
| 17 | 17 | | (B) an additional vehicle registration fee on a |
|---|
| 18 | 18 | | vehicle registered in the county; and |
|---|
| 19 | 19 | | (2) prescribe the types of transportation projects for |
|---|
| 20 | 20 | | which the revenue may be used. |
|---|
| 21 | 21 | | (b) Section 7-a, Article VIII, of this constitution does not |
|---|
| 22 | 22 | | apply to a tax authorized by this section. |
|---|
| 23 | 23 | | SECTION 2. Section 9(c), Article VIII, Texas Constitution, |
|---|
| 24 | 24 | | is amended to read as follows: |
|---|
| 25 | 25 | | (c) The Legislature may authorize an additional annual ad |
|---|
| 26 | 26 | | valorem tax to be levied and collected for transportation projects |
|---|
| 27 | 27 | | [the further maintenance of the public roads]; provided, that a |
|---|
| 28 | 28 | | majority of the qualified voters of the county voting at an election |
|---|
| 29 | 29 | | to be held for that purpose shall approve the tax, not to exceed |
|---|
| 30 | 30 | | Fifteen Cents ($ .15) on the One Hundred Dollars ($100) valuation of |
|---|
| 31 | 31 | | the property subject to taxation in such county. |
|---|
| 32 | 32 | | SECTION 3. This proposed constitutional amendment shall be |
|---|
| 33 | 33 | | submitted to the voters at an election to be held November 3, 2009. |
|---|
| 34 | 34 | | The ballot shall be printed to permit voting for or against the |
|---|
| 35 | 35 | | proposition: "The constitutional amendment authorizing the |
|---|
| 36 | 36 | | legislature by general law to permit counties to impose a local |
|---|
| 37 | 37 | | motor fuels tax and an additional vehicle registration fee to be |
|---|
| 38 | 38 | | used for transportation purposes." |
