55 A JOINT RESOLUTION
66 proposing a constitutional amendment to increase the maximum amount

99 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 1-b(e), Article VIII, Texas
1111 Constitution, is amended to read as follows:
1212 (e) The governing body of a political subdivision[, other
1313 than a county education district,] may exempt from ad valorem
1414 taxation a percentage of the market value of the residence
1515 homestead of a married or unmarried adult, including one living
1616 alone. [In the manner provided by law, the voters of a county
1717 education district at an election held for that purpose may exempt
1818 from ad valorem taxation a percentage of the market value of the
1919 residence homestead of a married or unmarried adult, including one
2020 living alone.] The percentage may not exceed thirty [twenty]
2121 percent. However, the amount of an exemption authorized pursuant
2222 to this subsection may not be less than Five Thousand Dollars
2323 ($5,000) unless the legislature by general law prescribes other
2424 monetary restrictions on the amount of the exemption. An eligible
2525 adult is entitled to receive other applicable exemptions provided
2626 by law. Where ad valorem tax has previously been pledged for the
2727 payment of debt, the governing body of a political subdivision may
2828 continue to levy and collect the tax against the value of the
2929 homesteads exempted under this subsection until the debt is
3030 discharged if the cessation of the levy would impair the obligation
3131 of the contract by which the debt was created. The legislature by
3232 general law may prescribe procedures for the administration of
3333 residence homestead exemptions.
3434 SECTION 2. This proposed constitutional amendment shall be
3535 submitted to the voters at an election to be held November 3, 2009.
3636 The ballot shall be printed to permit voting for or against the
3737 proposition: "The constitutional amendment to increase the maximum
3838 amount of the local option residence homestead exemption from ad
3939 valorem taxation by a political subdivision from 20 percent to 30
4040 percent."
