5	5	A JOINT RESOLUTION
6	6	proposing a constitutional amendment to entitle The University of
7	7	Texas at Brownsville to participate in the income and other
8	8	benefits of the permanent university fund.
9	9	BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Section 18, Article VII, Texas Constitution, is
11	11	amended by amending Subsection (b) and adding Subsection (b-1) to
12	12	read as follows:
13	13	(b) The Board of Regents of The University of Texas System
14	14	may issue bonds and notes not to exceed a total amount of 20 percent
15	15	of the cost value of investments and other assets of the permanent
16	16	university fund (exclusive of real estate) at the time of issuance
17	17	thereof, and may pledge all or any part of its two-thirds interest
18	18	in the available university fund to secure the payment of the
19	19	principal and interest of those bonds and notes, for the purpose of
20	20	acquiring land either with or without permanent improvements,
21	21	constructing and equipping buildings or other permanent
22	22	improvements, major repair and rehabilitation of buildings and
23	23	other permanent improvements, acquiring capital equipment and
24	24	library books and library materials, and refunding bonds or notes
25	25	issued under this section or prior law, at or for The University of
26	26	Texas System administration and the following component
27	27	institutions of the system:
28	28	(1) The University of Texas at Arlington;
29	29	(2) The University of Texas at Austin;
30	30	(3) The University of Texas at Brownsville;
31	31	(4) The University of Texas at Dallas;
32	32	(5) [(4)] The University of Texas at El Paso;
33	33	(6) [(5)] The University of Texas of the Permian
34	34	Basin;
35	35	(7) [(6)] The University of Texas at San Antonio;
36	36	(8) [(7)] The University of Texas at Tyler;
37	37	(9) [(8)] The University of Texas Southwestern
38	38	Medical [Health Science] Center at Dallas;
39	39	(10) [(9)] The University of Texas Medical Branch at
40	40	Galveston;
41	41	(11) [(10)] The University of Texas Health Science
42	42	Center at Houston;
43	43	(12) [(11)] The University of Texas Health Science

51	51	(b-1) In applying a portion of its two-thirds interest in
52	52	the available university fund to the payment of the principal of and
53	53	interest on bonds and notes issued under Subsection (b) of this
54	54	section for the benefit of The University of Texas at Brownsville,
55	55	the Board of Regents of The University of Texas System shall include
56	56	sufficient funds to pay the principal of and interest on all bonds
57	57	and notes, including refunding bonds and notes, previously issued
58	58	for the benefit of that university under Section 17(b) of this
59	59	article.
60	60	SECTION 2. Section 17(b), Article VII, Texas Constitution,
61	61	is amended to read as follows:
62	62	(b) The funds appropriated under Subsection (a) of this
63	63	section shall be for the use of the following eligible agencies and
64	64	institutions of higher education (even though their names may be
65	65	changed):
66	66	(1) East Texas State University including East Texas
67	67	State University at Texarkana;
68	68	(2) Lamar University including Lamar University at
69	69	Orange and Lamar University at Port Arthur;
70	70	(3) Midwestern State University;
71	71	(4) University of North Texas;
72	72	(5) The University of Texas--Pan American [including
73	73	The University of Texas at Brownsville];
74	74	(6) Stephen F. Austin State University;
75	75	(7) Texas College of Osteopathic Medicine;
76	76	(8) Texas State University System Administration and
77	77	the following component institutions:
78	78	(9) Sam Houston State University;
79	79	(10) Southwest Texas State University;
80	80	(11) Sul Ross State University including Uvalde Study
81	81	Center;
82	82	(12) Texas Southern University;
83	83	(13) Texas Tech University;
84	84	(14) Texas Tech University Health Sciences Center;
85	85	(15) Angelo State University;
86	86	(16) Texas Woman's University;
87	87	(17) University of Houston System Administration and
88	88	the following component institutions:
89	89	(18) University of Houston;
90	90	(19) University of Houston--Victoria;
91	91	(20) University of Houston--Clear Lake;
92	92	(21) University of Houston--Downtown;
93	93	(22) Texas A&M University--Corpus Christi;
94	94	(23) Texas A&M International University;
95	95	(24) Texas A&M University--Kingsville;
96	96	(25) West Texas A&M University; and
97	97	(26) Texas State Technical College System and its
98	98	campuses, but not its extension centers or programs.
99	99	SECTION 3. Article VII, Texas Constitution, is amended by
100	100	adding Section 17A to read as follows:
101	101	Sec. 17A. (a) The transfer of The University of Texas at
102	102	Brownsville from Section 17 of this article to Section 18 of this
103	103	article by the constitutional amendment proposed by the 81st
104	104	Legislature, Regular Session, 2009, applies beginning with the
105	105	state fiscal year that begins September 1, 2010.
106	106	(b) Beginning with the state fiscal year that begins
107	107	September 1, 2010, the funds allocated as provided by Section 17(d)
108	108	of this article to The University of Texas at Brownsville shall be
109	109	allocated to the other agencies and institutions eligible to
110	110	receive funds under Section 17 of this article in proportion to the
111	111	other funds allocated to those agencies and institutions as
112	112	provided by Section 17(d) of this article, until the legislature or
113	113	designated agency eliminates The University of Texas at Brownsville
114	114	from the formula and allocations made under Section 17(d) of this
115	115	article.
116	116	(c) This section expires September 1, 2017.
117	117	SECTION 4. This proposed constitutional amendment shall be
118	118	submitted to the voters at an election to be held November 3, 2009.
119	119	The ballot shall be printed to permit voting for or against the
120	120	following proposition: "The constitutional amendment to entitle
121	121	The University of Texas at Brownsville to participate in the income
122	122	and other benefits of the permanent university fund."
