 SENATE JOINT RESOLUTION
 proposing a constitutional amendment providing that the holdover
 provision of the Texas Constitution does not apply to a member of
 the Texas Transportation Commission.
 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1. Section 17, Article XVI, Texas Constitution, is
 amended to read as follows:
 Sec. 17. (a) All officers within this State, other than a
 member of the Texas Transportation Commission whose term has
 expired, shall continue to perform the duties of their offices
 until their successors shall be duly qualified.
 (b)  A member of the Texas Transportation Commission whose
 term has expired may not continue to perform the duties of a member
 of the commission, and a vacancy is created in the member's
 position.
 SECTION 2. This proposed constitutional amendment shall be
 submitted to the voters at an election to be held November 3, 2009.
 The ballot shall be printed to permit voting for or against the
 proposition: "The constitutional amendment providing that the
 holdover provision of the Texas Constitution does not apply to a
 member of the Texas Transportation Commission."
